The rider must’ve realised the humans very likely had a dog/s with them. It wouldn’t be her fault obviously had the dog attacked but surely it’s about not putting yourself, your horse, people or dogs in harms way. Not creating the stage for an accident and then having to work out afterwards...
Technically yes, legally not so sure - and the horse - travelling at circa 35mph? - would’ve appeared before the dog owner remembered where its lead was
Reading this I had immediate flashbacks of poo picking a field of what later turned out to be a rig. He took a chunk out of my shoulder after getting up behind me and would happily have done worse had I not been close to the electric fence. Hopefully yours isn’t one but worth considering perhaps.

I’m sorry to hear of your illness - I hope you can do lots of things you do enjoy. Re your horse, can you do a LWVTB? If not it sounds very much like you only settle on a new home for him where you are confident he will be able to live out his years, so please don’t beat yourself up now.
How long has your horse been away? I think I’d expect to hear how they’d settled in and then once a week, perhaps twice to begin with, especially if you know there are significant challenges involved
