A very long one. What should I do?

Thanks in advance if you get thruogh this! Last autumn I sold Tyler 2 yr sec A very cheap to what I thought was a good home, she was a bit of a rough woman but had had a seca driving ponytill he died. She lived at the livery yard so off they went. All going great for a few months long lining walking outetc.

Then I was selling another pony , a few trial homes went wrong and she came back not a good childs

pony. Rough woman asked to ride her to help me out and she managed her well . I agreed to sell her the 2nd pony and she could pay in instalments. She signed a contract ageeing to basically look after her properly etc, witnessed by my farrier. Now its all going wrong

she hasnt touched Tyler for weeks and has been chucked off yard. I found her another yard within 4 weeks she had been told to leave this yard with only a days notice.

At the mo both ponies are in my spare field. Neither yard owner will twll me why they chucked her out but say she not looking after them. Neither has seen a farreir for 4 months,

no other yard will take her and I have given her 3 weeks to find somewhere. I am damned sure she hasnt been to see to them since friday. T

hey both look ok not thin but were both pretty fat anyway. she hasalso been evicted from her home and is now homeless. I did feel sorry for her but its all her own doing she was given notice to leave her caravan but didnt bother looking for any where else. I have asked her to buy the ponies back s o i can resell one and keep the little one or put them out on loan but she wont hear of it.Now I am seriously considering just loading them up and hiding them, I have since heard she has conections with a lot of traveller families so I want her to think theyve been stolen,She left field unlocked and its on a main road so they could be. She has breached her contact over buying the 2nd pony on several counts and has only paid 2/3rds I still have passport. I would even say she only had them on loan as she has no reciepts or proof of our arrangment. What can I do I am so worried and am loosing sleep, I wish I had been told the truth about her to start with but nobody did until now .

I do feel sorry for you, why won't she sell them back to you. It would be by far the best solution. Don't do anything silly or illegal if you are a member of the bhs I think you can get free legal help about the pony she hasn't paid for , as she seems to have broken the contract

I dont think she has a strong grip[ on reality and cant see the problem. I have thought about getting legal advise on the 2nd pony but I dont want to leave tyler on his own as he might try and get out and injure himself. I need them both back
 
Obviously you cannot claim they are stolen, that gets you into all kinds of trouble. However, you could possibly take the view that they have been abandoned on your land if she hasn't made a formal arrangement with you. You could then seize then, issue her a notice for livery payment, and at the conlcusion return the horses to her....it may be the costs might spiral up to the value of the horses and she will just sign them over to you....

In any case, if you were thinking of doing this you would have to move them to a location where she couldn't easily find them.

The rider in this is that it sounds like she might have some unpleasant friends and you have to consider the safety of your family, home and horses above these two ponies, who are at the moment quite safe in your field
 
I am not certain of this, but I think you might have some grounds for repossession of pony No 2 - since she has not paid in full and has broken a witnessed contract. The main problem here is the lack of receipts in either case. You might be able to get a welfare concern established (taking advantage of the new guidelines) as regards their feet, or, if the 'neglect' continues, on grounds of abandonment.

How long this will all take, though is another matter entirely and I am thinking if eventually the upkeep and homing of these ponies is too great, she may well hand them over voluntarily?

Thanks do you have any idea where I could find details of these new guide lines i have just been and checked them and I just cried especially as I had just given my horses there nice big haynets and dinner .I am going to start feeding the ponies tomorrow if she hasnt been to them. I cant contact her as her phone is flat and she is apparantly living in her car!
 
These people should be locked up. You will have to do something as I say try ringing the BHS tomorrow.Imagine not seeing to your horses on a day like today [I'm nearly crying so as I say I feel for you]. You could also try trading standards I think they give advise to both sides.This woman must come to the reality of the situation and sell them back to you.She may need to sort out her life and everyone has bad times but at least she has an offer of help. Put it to her like that that you are trying to help her out so she has one less thing to worry about
 
I cannot stand people like this there are two poines in a field next to mine and a few months ago they were uncontactable when their horses got out, the owner of the land has been trying to contact them for several weeks before hand and after the incident because they were not turning up. Gah people shoudln't be allowed horses.

I understand your need to hide them and try and protect them but I woudln't if I were you as it may cause even bigger problems. I would attempt to get legal advice on this as the owner still owes money for the second pony and their keep then you may be entitiled to repossess them.

couple of words of advice, don't mess if she has these types of friends, seriously not worth it, trust me.
 
Beware of starting up a load of trouble, I would offer her cash for them, if she is in dire straits any offer like that may be welcomed.
If not give her in writing the amount she owes, warn her if she doesn't come up with the money she owes you will use the small claims court. (don't think you can without a proper address but perhaps the bluff may work)
I think she may just move to another field somewhere but at least try buying them back. (the amount you offer needn't be their value)
I would make sure you stick within the law, it's easier in the end that way.
