Advice about picking up horse that is out on loan URGENT

Baisically i have rang the people that have my horse out on loan and told them i am not happy as theyt have broke 4 conditions of my contract and they had a right go saying they want him gone by 5pm today i have arranged for this to happen i am going with the people to get him and i told her i would be there by that time and could she have him and his tack ready etc
She said can you have my money ready for a vets bill that she had to have out when he cut his leg in her care.
I ignored this message and then she sent another message saying i haven't thought about his wlfare in my decision and i will never ride him and never beable to get as far on him as she would have and he is going back to my yard which she called a [****] hole and he will be back to being a welfare case which he wasn't he has farrier every 8 weeks and is well up to weight maybe he isn't ridden every day but he is well looked after,
I said it was a nasty thing to say and any more threatning messages and i will have the police there to meet me
What do you suggest i do tonight if she won't give him back to me untill she has her vet bill money back
am setting off at 2.45pm

! Personally if it's not a massive amount, pay and go rather than drag it out esp if the horses welfare is at risk.
 
I would suggest taking a couple of burly men with you.
And tbh at the end of the day there's not alot she can do to stop you taking the horse away, if you can just get there, get the horse and go it might be best.
I'm assuming the contract stated that whilst the horse was under her care, she was liable for vets fees? In which case she hasn't a leg to stand on it terms of using that as her reason not to give him back.
Might be worth calling local police and asking for there advice and perhaps to be on standby for back up if needbe.

I'm sorry this has fallen through and turned out so nastily (I'm promise you not all loanee's are like this!) I hope you all get back safely.
 
firstly if you have passport she has no right to keep your horse and also did you have a contract to say she had to take full responabity of you horses care if it becomes injuried or unwell while in her care
if problems arise then contact the police
 
i have two women and one man coming hopefully we will be ok will ring police if need be i do have a contract stating she is in charge of payment of vet bills will let you know how i get on and maybe show you my black eyes she gives me lol
 
You don't owe her any money - so tell her to shove it.

Take someone with you - inform the police, and go get your horse.

Legally she can not refuse to return him.

Was this the mother or the teenager giving you the 'lip'???
 
imo...if she had your pony on full loan...then it shouldve stated in the contract that all vets bill etc are to be made by the loanee....not owner!
I would just get my horse out of the yard and then you can deal with this other matter later....she cannot stop you from taking YOUR pony if she does I would suggest calling police in for backup - as she's technically withholding your goods = stealing....
This is my opinion, please do not go alone either so you can have a witness to situation...main concern is getting your pony loaded and leaving!!!

best go will let you know how i get on have contacted her yard owner aswell to let him know the situation apparantly the person picking him up is a very big burly man lol
 
I have been in a similar position recently, and this is what we did;

Firstly contact the police, notify them of the situation, and that you are going to retrieve your pony. Don't ask them to be present, but just make them aware that they may be needed.

Then go to collect pony with a copy of the contract that they signed. Don't go alone, make sure that you have at least one person with you, as a witness if nothing else.

Remove pony from their premisis. They cannot forceably hold onto pony. If they try contact the police that you have pre-warned. The phonecall will probably be enough to get them to co-operate, but if not, the police can intervene.

In our case we managed to get the pony but still have been unable to recover tack and passport. The police are looking into it, and I am currently havng a solicitor look into retrieving either the money or the tack.

thats funny when i spoke to he police about a loanee not giving tack back they said there was nothing they could do as we loaned it to them, and pretty much said the same for the horse if they didnt want to give him back. mayb that is just my local constabulary though they said its a civil matter.

I'd go with a few big (!) people and take your horse back. I would NOT be giving her ANY money at all - if the accident happened in her care, why on earth should you pay?! When someone takes on a loan horse, they have to pay as if it was there own. She has no right to keep your own horse from you. Let us know how you get on.
