Advice - can I accept? What would you do?.....

So....... About a month ago I went to see a cob that my friend had heard of looking for a new owner as his owner wasn't well. So I went up with my friend to look at him and he was very sweet but didn't have any info about him or what he has done etc, I tried to contact the owner while we were up at the field but no answer (she couldn't be there when we went to see him).

A few days later she texted me asking if I was interested and she said she wanted £900 as she had paid £1000 for him and to let her know if I was interested. BUT the way she had explained things to the landowner is that she was looking for a good home rather than money.

In the mean time my poor dog has slipped a disc and is on cage rest for 6 weeks and ££££ in vets bills so I politely texted her back saying "thank you for replying and I am able to offer a good home but at the moment can't afford to pay out that amount of money as my dog has a slipped disc". No reply from owner......

Today landowner phoned friend to say that the owner has sadly passed away (committed suicide) and could I offer the cob a home?

Where do I stand about this? Am I able to take the cob? I would give him a very good home. Also passport - I don't know if he has one and if he does/doesn't would I be able to apply for a new one explaining the situation? (wouldn't be able to get it if he does have one as she had no family to contact)

Sorry to moider on and I hope what I have tried to explain makes some sense.

Horrible situation. Re passport she must have some family contacts, a solicitor or someone managing her affairs, if not her local Authority will be organising the funeral. In this case you might be able to contact them to explain the situation. I cant see that they would object to giving you the passport.
 
All depends on the situation with the owners estate, the cob may need to be sold to pay debts or for funeral expenses and its for the family to decide not the landowner as its not his horse to sell.

Depends on the family of the lady i would expect!
Are you in a financial position to take on this horse? If not then i would suggest that you advised the land owner to contact the WHW or similar.
Unless there is anything in the lady's will (if she had one) about him going to someone else, as far as i know you can take the horse on. In regards to his passport, if he hasn't got one you'd be able to get a new one no problem i should think.
How sad that she committed suicide though =/ Sorry your in this position, i hope things work out!
 
Just a thought, might get shot down in flames for this... are you sure the owner has passed away and the landowner hasn't decided to just get the horse moved on without permission?
 
Does she owe rent to the landowner as if so, he can put a lien on theorise and take him in lieu of rent therefore it's his to do Ashe wishes and he can give the horse to you.
 
I think you need to make contact with who ever is organising the funeral and see what the situation is re family/next of kin etc. The horse is part of her estate, but clearly someone needs to look after it in the meantime until matters are sorted out. Once they realise there is an ongoing cost in the form of field rent, feed etc etc, it is possible they might be happy to sign the horse over to you, all legal and above board.
 
Hi thanks for your replies. The owner has passed away she has committed suicide she was a drug addict. The owner has not been down to him for weeks and the land owner has been giving him water and hay and he is kept with the landowners two Shetlands.

No one really knows much about the owner she is a friend of a friend of the landowner. No family though.

I dont even suppose this's cob will have a passport but don't know how to find out if it did and who with etc.

I can afford to take him on and give him a good home I just couldn't afford the pay out of the price she was asking when she asked as of the situation with my dog but we are 3 weeks in with him now and he is coming on in leaps and bounds. I would have bought him when she asked if my silly dog hadn't have injured him self!

Oh dear I just don't know what to do for the best.

Id try to speak to the family, tell the land owner you can take him on, but only after speaking to and getting something in writing from the family, passing on a nominal sum for ownership.
 
I think you would need a family member to give permission for you to rehome.
Or whoever is in charge of their estate or whoever inherits it.
If passport is lost you will need some proof like a letter explaining things from the person who inherited the horse.
As for taking on the horse, its an unknown so be prepared for the bad but hopefully a a good horse will come out of it.
 
How very sad. Well I am not sure of the legalities but I hope it all works out and you can take on this cob as it sounds as though you can offer a good home. I purchased my recent filly without a passport, assumed she had one initially then after I said I would buy her found she did not have one, I simply applied right away and now she is now fully passported, chipped, vaccinated and wormed, all of which she was not! I know its quite different but hopefully you can find out more, get it agreed and just send off for one and become the legal owner. Good luck with it

I am going to have to contact the landowner to find out more but by the sounds of it there isn't much more to find out.

I don't think she was paying any rent for the grazing he was just helping out as he has quite a bit of land.

Watch this space will let you know what happens.
