advice needed regards to payment of backing

my friend needs advice and whether she is entitled for her money to be given back
my friend has a gelding who has been turned away due to back issues , these have been rectified and now is back to full health , problem is woman brought it for her daughter who know thinks horse may be a little to much for her , he was booked in for april to be re backed and when returned will be sold but someone has offered to buy him now and will re back him there selfs
my friend has told the woman this who he is booked in with and now woman refuses to refund money as she said she has keeped stable for him , but surely the stable would nt be held till the end of next month .
anyway do you think its right for woman to pay back the money or is it a loss

It seems very odd that anyone would pay the full amount for backing a horse that far in advance. A deposit yes, but full money? If a deposit, then the trainer is entitled to keep it. Normally though it would be stated that it's non returnable.

she apparatly hasnt signed anything , so looks like she hasnt a leg to stand on , shes either got to send or lose the money by the looks of it
 
As someone who used to back and start horses, I would not have taken a dime off you until you arrived with your horse. But then yeah I would expect a month up front. At times it would get busy and hectic and so working out a schedule for beneficial for both parties could be difficult but I wouldn't expect money. Horses get hurt, horses sell, people's life and priorities change so do not expect deposits.

I don't think this woman is being very fair at all. A little compassion and understanding would be nice. She should refund her the full amount and wish this person luck. She will find this does more for future business than holding onto money she thinks she deserves.

Your friend payed someone £600 and didn't get a receipt or contract?

Anything could happen in month before the date.
What if the horse got injured or even died?

Your friend is definatly entittled to her money back even with just the deposit deducted.

Write a letter asking for owed money or start a claim.
