Advice please with Livery?

Hi,
Our YO has recently decided that her ground is not able to cope with grass liveries. She only has one grass livery and has only been able to contact the owner via letter to say that her horse needs to be moved.
The problem is that the owner of horse is frightened of him and does not take horse out of field. The horse has been in this field since September and the field is in a dreadful state. YO is worried that owner will not move the horse.
Anyone know where the YO would stand if this were to happen?

Owner of horse has disappeared for a while before for 2/3 weeks. She comes to see him 10/11pm at night, horse has a very nasty cough and gunky eye.
YO does not like confrontations

Do you want legal information? well the outcome would depend partly on whether there is a contract in place? What are the conditions of livery? Is there a miminum level of care the owner must provide to be on the yard etc? Also has the owner being paying her bills? Is the horse dangerous? there are many issues to consider- if they have a contract and that this states the YO can ask for the horse to be removed with notice than the owner must abide ny this or face further consequences.

A tricky one, a couple of years ago two gypsey horses found their way into my neigbours little paddock. She called the police, the r.s.p.c.a and anyone who would listen. Nobody wanted to know, the horses were off the road and safe as far as they were concerned.

She tracked down the owner and there was lots of shouting and swearing as she had just re-seeded her paddock and one of the animals was a donkey who kept us all up all night. I think it took her two weeks and she ended up loading them in her trailer and dumping them at the caravan site to be rid.

I think the best way, if your y.o has no success is firstly not to accept rent. Then secondly to have a legal letter drawn up asking for the removal of the animal. If rent has not been paid, she could threaten to take the horse to market to recover her costs.

Under no circumstances accept payment for the paddock, then effectively the contract of verbal agreement has broken down, this would be the first step.
