Hello, Was hoping someone would be able to advise me please :)

Slightly long winded story, an owner who rented a part of my field where I keep my mare bought a new horse into the field, who later turned out to be a colt. Before she purchased him, the colts owner lied about him being a gelding and no one questioned her. He was only found out to be a colt when he was put in the field. Her reasoning being "he doesn't know what to do with it".

She had him cut after a few weeks, he was separated from the other horses, but grazed with my mare over winter.

I now suspect my mare may be pregnant, having the vet out next week to examine her. I'm also slightly worried because she is 16/17 and has not been fed adequately for a mare in foal over the winter.

I'm just wondering if anyone knows where I stand legally? If she is in foal I am now saddled with a horse I did not want and can't really afford, is the owner of the colt liable for any costs?

I'm sorry if this sounds like it should be on Jeremy Kyle! But I'm wondering if anyone has any ideas.

I suspect that if you haven't said anything when the colt was grazing with your mare over winter that there will be little that you can do. Your best bet is probably ringing the BHS legal helpline, but worth considering that if it causes bad feeling then you might lose your grazing, although it sounds as if you may be better off elsewhere.
ETA I wouldn't worry about the feeding aspect, as long as your mare is in reasonable condition she is better off than being fat. I'd be more concerned if she is a maiden mare at her age.
 
Thanks touchstone, forgot to add the owner has since left the field after her horses not being fed properly so trashing fencing and getting in with other people's horses!

Will give the BHS a ring to see what they say
 
Older maiden mares can have more difficulty foaling, but I'm sure your vet will keep you right. Hope things get sorted for you, it sounds a worrying time.
 
Ok Thankyou. Yes fingers crossed its a false alarm. Not really the worry I need but I will know next week!

Lol! She'd then find herself with a bill of all the fencing her horses trashed and the hay they were given to stop them starving!!
