advice wanted from yard owners please

a good friend of myn has recently had a naughty phone call made about her to the authoritys about her small livery yard and rates ect.she has maybe 8 liverys not including her own horses so im just asking for advice regarding the rates ect ect that she will or likley to incur by having to go through the proper channels and declare it all as a business,,,,, i would have put malicious about the phone call but spelling isnt by best forte
 
Our local authority charges £15 per week per stable, whether occupied or not. The school is £5k a year....then you have all the health and safety plus fire regulations. They will also probably want the muck heap removed regularly by hazardous waste specialists too......:(

My gosh, they don't have any problem taking money do they!
 
I am not allowed to do liveries but still have to pay for my own horses, I have 5 stables and they charge me nearly £100 a month. Next door pay nothing as they never got planning permission but have the same as me.
 
DDD has just about sumed it up, you have to pay for stables even if empty, plus all facilities, be it schools or a field set aside for jumps in the summer, you have to have your fire extinguishers serviced every year and our local council has a livery yard inspector who comes round every year to check out health and safety and also that these are covered in the livery contract and that the relevant health and safety signs are up around the site and you must have planning permission for the amount of liveries you have in the yard plus any floodlights you have in your schools, everything is rateable as its classed as a service.

They also check that your muck heap is not near any ditches and is on a concrete base.

The only bonus is that the older the facilities the less you pay, so if you have something done now you pay top wack in 5 years time you can get it reduced.
 
I had a malicious call made to the local council when I bought another horse for myself and altered the garage next to the stables to make another stable. I had a visit from the water board on behalf of the council as they set the rates. I was asked if I let anyone else board their horse here. Answer NO. Do you let a friend keep a horse here FOC Answer NO. Because if you do you will have to pay business rates on this property and business water rates and Business Council Tax even if you don't charge them anything? My answer to all was NO I haven't got the room and I wouldn't anyway. But he still wanted to look round and see the horses passports were in my name. Funnily enough every other person with land had boarders except me and the evil sod knew this and just wanted to cause trouble. They also sent the council round saying we had started a new business from here as we pointed out we had permission from the council for the business that we run from here they just had to check we hadn't opened another one. When ever I do anything on our land I get the head of planning to come and look then ask that they put it in writing so I have something to fall back on.

That old saying Vengence is mine will come as I have sooooo much on them but I will bide my time

I think I would re-check that Carthorse. If they are your own horses you shouldn't have to pay any extra. If you do ask for it in writing and why as they are your leisure persuit and you do not have anyone else's horses.
 
I did have them out to check but they said I had to pay non domestic rates, my land is a mile from my house so not rated together. I become a pensioner in 4 years time and don't ever want to sell my horse but have no idea how I will pay on a pension
 
its not the phone call that was naughty but your friend is naughty running a business 8 liveries and not paying her due in rates and tax? has she commercial liability? god help her if it goes wrong! its just the same as dole fraud! making an income but not declaring!! its fraud at the end of the day...

Have to agree with above am afraid!
Just because it on her land why should she get away with not paying the appropriate rates for not declaring she is running a business(which she clearly is),If you are taking money from people you are earning a living from it,thus making it a business!She should pay like everybody else!We have a lady up the road from us that claims all horses,including the 4/5 liveries she has are her own

However i wouldnt make that phonecall,but i imagine 1 day someone will!
The likes of Carthorse however should not be paying £100 a mnth!
I too would look into that CH,gotta be worth digging about if it finds you are not to be paying anything!
