Ok, just to clarify.

And did the girl tell her they weren't eating the hay - and was she then given instructions on sourcing more elsewhere???

Firstly the woman in question sounds like a raving loon.
Secondly hurrah that you're standing up for an obviously terrified young girl.
With ref to the horses not eating the other hay and the girl running out - did she tell the woman this? What were the financial arrangements for the girl i.e. if a horse was injured and needed a vet or more food was required how was she to go about this? If the woman left no financial arrangements I can't see how the girl can be held responsible?

If she has been giving the horses hay - even if they would not eat it - she has not been starving them. It sounds more like the illness that the vet has failed to treat and that the owner has completely ignored, has stopped them eating.

I, like Patches, twigged who the woman was as soon as you mentioned going away and leaving the 18 year old looking after a child...

At the end of the day the owner is responsible for the horses and not someone who doesn't even have a legal contract to look after them all...

Plus you are a witness to the horses being ill before the 18 year old ever started working there.

Sounds like the vet and the owner have a lot to lose over this horse, and are covering their backs to blame the girl so that they dont get sued by the horses actual owner.

Why on earth someone would leave a horse that valuable in the care of this woman who is never there, is beyond me!!!

The girl phoned her to say that the horses were all looking thinner and should she perhaps worm them. Owner said no she would worm them when she returned homw. She told girl to start feeding them more. Girl phoned her a few days later to say she was very worried about the horses - this time the owner said that it was okay to phone vet.
 
When girl told owner the horses were not eating the other hay, owner just told her to feed them more of it and she would source another supplier when she returned. It was me that she contacted and told me that the horses would not eat the other hay after they had been fed on our hay and she wanted to sign up for me to be her supplier from now on. I declined her kind offer

Yes I also agree with your hitting the nail on the head. The one thing that the girl has going for her is that, from the statement I had her write last night, she apparently called the vet on no less than 10 occasions and the vet attended no less than 20 times in this period of time.
 
I would imagine so...although this has not been confirmed. The owner only told girl that the horse did not belong to her until she had horse destroyed earlier this week.
 
It is my understanding that in Ontario recording a telephone conversation is perfectly legal as long as ONE person knows it is being recorded - might be worth doing given the telephone conversations you have mentioned.

In terms of what the owner would sue the girl for - IMO negligence it is not - the vet was called, she deffered to his superior knowledge. The horse needs to be PM to determine if it was the ulcers that killed him (methinks not....)

There isn't a lot of point in sueing someone with no money - I am thinking the owner is trying to scare the **** out of her.

And owner is doing this very successfully. I have rattled around the Law in my head all of last night and this morning and I just cannot see what grounds she could possibly have for suing this girl. The girl apparently followed all instructions. I'll let you all know what happens as a result of speaking with our lawyers this afternoon.

Over in this country, I could have liveries that neglected their animals and yet ultimately, as the yard owner, I would be responsible and prosecuted for the neglect as I have a duty of care to horses boarded on my land.

Doesn't the same apply over there? She's the legal keeper/owner so ultimately the care for these horses are her responsibility alone. Having someone work for her is surely incidental. She's the person with the duty of care to the horses, not the girl who was left in charge of them. Employers can and are held responsible for the actions of their employees all the time. Hence why we have corporate manslaughter, corporate negligence, etc cases in law.

I would certainly argue that the girl did the very best she could in a bad situation. I would assume she had informed the owner that the horses clearly didn't favour this hay. The underlying illness is no doubt far more responsible for the condition of the horses than the hay.

If the horses were being starved, the vet would most definitely have spotted severe malnutrition and acted upon it?

I know it's a mess, but I still think the girl will be exonerated for her "part".
 
And this is what I kept saying to the girl last night. The owner has the overall responsibility here - anything which happens lies firmly on owners shoulders and hers alone!

Trouble has been brewed though. A whole horse community in another town appears to know all about this; I have never mentioned anything to anyone, and the feed supplier (who also boards at my farm) has not said a word except to me. The only person who could have told the stories to everyone else has to have been the owner. The girls reputation has already been put under scrutiny....
 
Well of course there will always be titterings when this sort of thing happens.

I'm sure that when the whole balanced truth outs, the other woman will be seen for the bullying, irresponsible waste of space that she most clearly is.

Getting legal advice as soon as is the best thing for your young boarder. The fact that she has your support and clearly will continue to do so, should in some ways help to allay her fears about long term damage to her reputation.

BH; I very much doubt that the owner will get to her lawyer today. We made the earliest appointment with our lawyer so that the girl can get in there first with her claim. We saw attack as being the best form of defence for her.
 
If the situation wasn't so horrible for the girl, I could see you enjoying this Tia! I think we should get you a wonder-woman costume for your birthday so you can be real superhero!

I have every confidence that (a) there is nothing this evil bag can do in law against the poor girl (b) you will help make mincemeat of said evil bag and useless vet and (c) that a well placed word or two will clear the girls name and back up how evil the evil bag is...

If all else fails, I'll come over and wield a sharp pointy stick at the old cow and then disappear... (possibly with a nice "hot" QH in my baggage that I hope Tia won't spot...)

Awwww, feel so sorry for that poor girl. I cannot imagine what she's been through with the awful woman. I'm sure some time playing ponies with you will help no end.
 
LOL!! I'm not doing anything that any one of you guys who have responded wouldn't do.

I deplore injustice and vicious aggression - that's why I have started enlisting the help of everyone who is involved in this so that we can all do everything we can to clear this girls name.

Let's hope that your Lawyer puts a stop to this sad business before it's truly begun and that you can clear this girls name, so unfair when she appears not to have done anything anyway. I am quite sure that you know plenty of the right ears to drop words into. Good Luck to all.

That is awful- thank goodness you are looking after this poor girl tia,
as a groom often responsible for horses (incredibly expensive ones!) in owners absence this situation sends shivers down my spine. Good luck, although I cannot believe that they can hold this girl responsible in the eyes of the law.............

Poor girl, they must feel no remorse in using her as a scapegoat.

I remember the last post about this woman and her daughter, does she look better now or is she still look unhealthy?.
 
Well the lawyer has this in hand now, so hopefully will have an update for you all at some point next week.

Thanks for all your comments and for helping diagnose the problem.
