Annoyed!! Advice please!

need your always excellent advice again guys!
I share a mare with a girl "sarah". We bought the saddle and tack box 50/50. We both gave our livery in cash every month to YO seperately and are responsible for our own payments. The past 3 months, I have been giving my money, then getting text from YO saying "sarah" never paid. I then ask sarah and she says "oh I transferred it". But it never arrives, then she pays cash a few weeks late. If you were so convinced you did transfer, why would you then pay cash??
YO called me yesterday and said I am to take charge of collecting livery payments as she is not prepared to chase sarah anymore and she knows I'm reliable (sarahs livery is 3 weeks late again since the mystery transfer failed yet again). But I chase her too and have no luck either!

I think I need to get another sharer, but the prob is she owns half of alot of our stuff and I haven't the money to buy it all right now. Plus she still owes 200 in livery and I can't absorb that either. Next months livery is due and that'd be a further 400!
I need a plan of action....any ideas??!
 
Break ties with her; who's horse actually is it?
If its yours buy her half of the tack and tell her you want to terminate the agreement
 
Sounds like a complicated situation.

Who owns the horse? The owner will have to take responsibility and treminate any sharing agreement if the sharer is not paying up. If you are the sharer and not the owner then ask the YO to speak to the owner.

Do you have anything in writing with Sarah?

As for the tack, since you bought it 50/50 you will either have to buy her out or come to an agreement to split it in half, otherwise she still owns half of it.
 
£200 is a lot to owe and pay in one go... Could you possibly ask YO if you could pay it in installments (obviously let her know situation...) and let sharer know that you paying her half the livery = you owning everything you bought 50/50? that way you can get a new sharer and not worry about her trying to take any of the equipment away...
 
Well if she owes you £200 already, how much did the saddle cost and tack box altogether? As you could say, don't worry about the £200 and I will keep the saddle and tack box and then pay her the rest, which may not be much more.

However, I would be inclined to have a friendly heart to heart with her first, incase she is having difficulty and maybe you could all come to some arrangement!

with the amount of livery owed, im sure you could use that as her half of the tack, (so she gets nothing) and then explain to the YO you will pay it off in installements. it might not work but just a idea.
if she owes you money then i would say that equates to you gaining the tack!
 
another one who thinks you should talk to Sarah first - she pays but is always late, so that looks like she has not budgeted or managed to have the money at the right time. Perhaps she thinks as no one has said anything, that its actually OK to pay in that time frame..

However if that doens't work - then you need to advise who owns the horse/what legal committements were made before you start drawing up plans! it does seem a bit unfair if you are both sharers that the YO has put the problem onto you though....!
 
Sorry, I had forgotten to mention that the horse is owned by another lady. Sarah has no relationship with her, but I keep in regular contact with owner.
"Sarah" is at home in the UK at the moment for new year etc. There is a very reliable girl filling in, so she could be a perfect permanent replacement.
I like the idea of paying her 200 livery and making that the payment for the tack etc. The tack and all would work out at about 200. Thanks for that idea guys!! I need some clear heads outside the situation!
I had it out with her 2 weeks ago, saying YO was texting me about her livery again and I shouldn't have to deal with her responsibilities. Said it was unacceptable as this is 3rd month in a row. She claimed YO wasn't checking her bank balance properly!! Now the livery is 3 weeks late and still no money :-(
And its not that she's short of money, her well-to-do parents are paying, hence the silly bank transfers instead of handing YO cash.
 
I'd be a bit careful with that. Sarah owes the YO 200, if you pay that on her behalf if does not necessarily mean you can take back 50% of her tack.

I think you need to speak to Sarah asap and if you don't get anywhere with her you need to let the owner of the horse know she might be losing a sharer.
