I have a horse who is injured and can no longer be ridden anymore. I have him currently living out in a friends field. I have advertised him as a companion but since have become worried about what could happen and have heard awful stories. A lady has rung me about him, and seems quite keen. I would obviously get her to come and meet the horse, and also go and check out where he will be going to live, but if she is ideal i dont want to deny him a loving home with someone who will have more time ffor him than myself. I was wondering does anyone know is there some kind of contract that can be drawn up, stating that she cannot sell him/loan him etc, and if she doesnt want him anymore then i have him back, some sort of loan agreement? also... do these agreements actually have any legal meaning , and if anything did happen would i have a leg to stand on?!

thanks!!

yep go on the bhs wecsite and they have print out you could ammend it to state he is not be sold or moved on as long as they have signed it and so have you, this would be a legal document or even just write one up just aslong as it state clearly.

If you put him on loan, the BHS website has a sample loan agreement which you could use.
If you sell him, or give him away, however, then even if you have clauses to the sale, they are not legally binding, and you have no rights.

Be careful - there are fake charities around who are contacting people such as yourself, but they rehome the horse (often within days) for a fee i.e. sell him.

There is a loan contract on the BHS website.

I once mentioned to my vet that I was considering loaning one of mine out and he said that if I was to do it, to do it properly and get a contract drawn up with a solicitor.

All I would say is make sure it is water tight, and GET A COPY, in my naievity, i made an agreement and let him go without getting a copy back.

So now have no come back.

And make sure you make regular checks until you are happy.

My loaners said I had to give 48 hours notice of coming, do not do that, the only reason I can give for that is that the loaner wont be in, but I see that as no reason not to check yor horse in its field.

I went any way regardless, and one day he was gone.

Do not want to scare you, and I hope it will go great, I know mine went wrong letting him go without a signed agrreeement copy

thanks for all the advice! is the loan agreement on BHS website legally binding, or would it need to be done by solicitors etc?

usually as long as they have signed it and declared it this should be enough but check with the solictors usually not likely to need them.
