Hi all,
I'm sure some of you will know I found a lovely little project ex polo pony for sale, so I seen her a couple of times and she passed the vet check so I put in an offer and hadn't heard from the owner by the time she said I would. So I contacted her and offered more thinking this was the delay as they wanted the asking price again she said she would get back to me. So after a tense week she contacted me last night and said she was still waiting to hear from some else about the pony!!!!

Turns out this other buyer saw the pony a couple of weeks before me and said they would take her but they hadn't sorted out livery or anything so couldn't take her until they seen if they had somewhere to keep her.then the owner didn't hear from them, So the owner didn't know if they where just wasting her time so she let me come and see the pony and pay for a vet check and yes I have livery and everything sorted before I even started looking for a new horse. So I offered to buy the pony could pick her up anytime (she's only 20min away from me in the car) but the owner contacted this other person first to see if they wanted her. They've messed about this week saying yes they would take her but they wanted checks to be done by a vet.

The owner then phoned me back last nights and said she was really sorry and the other buyer had just contacted her and said they would collect her on sat. She did say that she has another horse that is her one of her daughters eventers that she would be happy for me to take for the next couple of months until her daughter comes back (she is currently away eventing with her other two higher star eventers) and they would also be willing to sell. I think it's very nice of her to offer but I would be gutted taken a horse that in a couple of months I might have to return because her daughter doesn't want to sell. The horse is also a 1 star eventer and was breed for eventing but I don't know if I would be looking at competing this horse at a higher level so would feel that she was wasted.

Sorry for the long post I'm just upset that a seller would waste a buyers time like this :(

Seller is potentially on very dodgy ground - and you could possibly pursue her through the courts if you wished to.

On what basis did you arrange the vetting?
 
I asked if I could arrange a vet check with my vet to make sure there was no problems, old injurys ect. And if everything came back fine from the vet I would take her. She passed the vet check pony very over weight as she been at grass for about a year and hasn't been worked so needed brought back to work and fitness but vet didn't think that would an issue so she passed the vet check.
 
That is outrageous that she allowed you to go ahead with a vetting. If it was me, I would be emailing her if possible and trying to get confirmation in writing that she had the other buyer in the pipeline prior to allowing you to organise a vetting. Once I had that confirmation in writing I would then be asking for seller to pay vet fees! Text might work too???

Best of luck, but as far as the other horse - I would be walking away. Once bitten and all that. You will find something nice - chin up ;-)
 
That's how I read it amymay but I thought I must have been wrong! If that's the case I would certainly be pursuing reimbursement of the cost of the vetting. Saying that, I would not have arranged a vetting without having agreed a price & left a deposit anyway xx
 
ummmm i smell a rat here.... seems all a little odd to me. Has the seller changed their mind or selling to a friend? Sounds very unfair to me!

I would be asking for vetting costs back!
 
I'm sorry but since YOU paid to have the horse vetted and the other potential buyer hadn't even done that the seller is BANG out of order.

How on earth could you let someone pay for a vetting knowing you were waiting to hear from another buyer and would sell to them if they said they definitely wanted horse. That's awful and if she has any shred of decency she will offer to pay vet fees. I would not take this as nicely as you I'm afraid. No I wouldn't want arguements/upset but I'd defo be saying I wanted owner to contribute or pay for vetting. Was it a 5 stage? If so sell owner the cert so the poor horse doesn't have to have another 5 stage next week!
 
Maybe owners happily accepted a vetting so she\he could tell other buyers that horse passed etc..
Either way the buyer I feel was wrong, as getting a vetting would show commitment to buying the horse.
 
Sorry was tring to keep my post as short as poss so think I've wrote it in a confusing way. When I first saw the horse we discussed money for the horse which was slightly less than they wanted but they seemed ok with it but I wanted a vet to check her out before I took her which was fine with the owner. Myself and my OH who was with me offered her a deposit but she said no we don't need that and wouldnt take one. We again offered her a deposit when the vet checked her out but again she said no it was fine they didn't want one. I then increased what I was offering thinking the delay was that they where holding out for the full asking price and then found out that they where in effect holding the pony for someone else. Hope that makes more sense. In hingsight I should have had alarm bells ringing at that point but I really liked the horse and wanted her.
 
I would definately be chasing her for the cost of the vetting and your fuel - speak to her on the phone, and if that doesn't work, tell her you will be contacting a solicitor and get one to write a stern letter asking for the money back. She has treated you very badly.
 
the only way to avoid this situation is to put a deposit down and get something in writing stating that horse is sold to you subject to vetting.

if you dont you leave yourself wide open to being messed about as you've now found out.
really sorry you're in the situation but you're just better off chalking it down as a lesson learned

If the pony's gone now id walk away and start again.

They still allowed you to pay for a vetting whilst holding the pony for the other person. They should have made you aware about the others & agreed to contact you if they backed out, saving you time, money & heartache.

I would still pursue a refund of your vetting xx
 
I'm going to speak to her tonight about it as I've to contact her about this other horse she has, OH says their is no way we are taken on another persons horse for a couple of months for me to bring back into work (she has also been at grass for the best part of the year) for them to take back when they please when there's no guarantee that they will sell her as it depends on what thier daughter says when she gets back. OH has some strong view on it and has said some really bad words since last night :D he thinks they didn't tell me about the other buyer so they could try and offload the other horse to me when I didn't get the one I wanted. But hey ho I'll put it down to experience and keep searching.
 
I think it's six of one and half a dozen of another. They should have been more honest, you should have been more persistent and businesslike.

Very sad for you at the end of the day and a terrible shame and wasted time and effort

If the other buyers have been a bit rubbish and flakey so far it could be that the deal will still fall through

If that happens offer your original price in cash and get in and out with the pony swiftly obtaining a receipt on the way
 
I would not in a million years be taking the other horse from these people! I think your OH sounds sensible. I am so annoyed for you it is really out of order deposit or not!

You definitely need to try and get the money back on principle. IF the other buyer flakes and the sale falls through you COULD still make your original lower offer, but I would be wary of these people being truthful about anything!
