I'm not aware of any further news.
I don't know why the post was pulled as only saw it early on so lord knows what went on.
As far as I am aware the lady who has the horse is fully admitting she has it but is refusing to disclose where it has been moved to.
To my knowledge the issue started when BER ceased the loan on the grounds of welfare concerns. The horse was then moved without permission and is still missing.
Someone may know more than i but I think that is the latest.
 
HMmm I was looking for the origional thread and just thought it was me that couldn't find it! The girl (18y old) who has the horse will only say he is 'somewhere safe' - I do think other locals know but no one is saying - very wrong as the dispute should be properly sorted by the people involved. However I know people are still looking for the horse and putting posters up not having any idea of whats really going on. Again very wrong as they actually believe the horse has been stolen (as in taken from his field by strangers) which, in reality, he hasn't.
 
If he's been moved while on loan without the owner's permission, and the loaner is refusing to reveal his whereabouts then he's stolen.
 
Yes I know technically he has been stolen but not in the way locals are thinking! It is very wrong to hide him and he should be returned but having local people panacking that their horses could be next is wrong. To the owner of this poor horse it is very distresing and I sympathise but locals should be made aware that this is a dispute and not some gang out to steal horses.
 
However have we been told the whole story, does the horse really have welfare issures due to neglect of the new owner.
Although if it dosn't ber is still as far as I am aware entitled to terminate the loan agreement, but it would be rather distressing for the new owner, and may explain (not justify ) their actions.

I still remember that poster ber did, after the rather dubious purchase of this horse.

I'm concerned that there is a horse out there somewhere that may (not proven) need veterinary attention or at least the work on it's feet that had been agreed.
I'm concerned that BER can't get hold of the horse that is still legally theirs.
I am really concerned that an 18 year old could end up with a criminal record for this. I'm a solicitor and she is currently fulfilling all the criteria of theft under sections 1-7 of the Theft Act 1968. (based solely on the information that we currently have)
not least I obviously feel for the girl who has Old Tino as she would find it extremely distressing to give up the horse.

Saying all that, I too am not sure we have the whole story here. I just hope it gets sorted soon for everyone concerned. There must be a way to get the horse back (or at the very least treated) and the young girl to not get prosecuted.
 
Ifa loanee had taken my horse when on loan I would have been posting it as stolen as well, to every equestrian establishment I knew locally, and to every forum I knew that local people were on. I would also put ads on for sale sites stating that the horse was stolen etc.

If the girl who has this horse is only 18, then she is possibly acting on the advice of someone older with respect to moving it, but basically, she new at some point she would have to give the horse back as its on LOAN. So why should she panic so and hide it? Thus making the situation a lot worse for herself? If the horse is neglected, then I dobt the girl would be that distressed at loosing it, as she obviously wasnt distressed at not looking after it properly.
 
I cannot believe this horse can have travelled far in current weather conditions but could someone post the Crime Number and suggest to BER that Famkey is contacted to get an entry onto the Stolen Horse Register.
 
If the horse is indeed stolen, shouldn't the first port of call be the police to report the alleged theft officially, rather than relying on noticeboards and people on forums?

If the horse is stolen, why would anybody not wish to report it and thus open up more potential avenues as Cuffey advises?
 
The details of this horse are not on the Missingonloan website, would suggest they are put up there, they have really good results. Surprised this hasn't been posted on the Stolen section as well.

Its not on the back end website either... Makes me wonder if it really has been stolen or if someone is spreading this story as a way to have a dig at Toni?
 
If the horse has in fact been stolen then the first step to take is for the owners to report it to the police and get an incident number.

Once they have this it can be reported to horsewatch and horsewatch will circulate it's details immediately to all the horsewatch team around the country as well as post it on the horsewatch web site.
 
Does ber has a contract with the loanee, if she does then unless she can prove negligence she my well find she is unable to take the horse back until the contract is up.

Which leaves me too wondering if the horse is stolen at all?
 
The horse was in a very poor way when the loaner took him from BER. It would be sad if he ended up back there, considering he has apparently improved considerably in the time with the loaner.

Considering the number of times 'stolen' has been used on all the various sites I'm confused as to why no official steps have been taken?

From what I've been reading here there and everywhere there seems to be quite a lot of nasty accusations being banded around that could be verging on libelous - including the accusations of theft if those accusations are not backed up by reporting the fact to the police?

Tino has been found safe and well on a livery yard near Leeds. Unfortunately due to the lies told by Jacque and her family his ownership is in dispute and the police say this is now a civil case. I have retained an equine law solicitor who says that she is confident we will have him back home where he belongs quickl...y.

Jacque's family are also stating that there are serious threats being made towards her and I ask now that this stops immediately. This page was set up to find Tino and now that we have I intend to close this page at midnight tonight.

How can somebody who relies on donations in order to feed her animals possibly be able to afford 'specialist equine lawyers' in order to determine ownership of a horse? Why on earth is there any dispute (unless the horse doesn't belong to BER or her contract is dodgy)?

Quite frankly, if that family really are at the receiving end of threats there is only one person who is accountable for that - the person who has whipped this whole thing up into a vicious frenzy.

I hope BER knows what she's taking on!
 
And if the horse is safe and well where is the problem, it was out on loan so we are told so is still out on loan safe and well why waiste money n a solicitor removing it, money that could be better spent saving more equines or looking after the ones you have already when the said equine is safe and well with a loan agreement.

imo mission acomplished what is the problem?
 
Funny how the side that is on the attack always considers the other to be telling ''lies' when it doesn't work out in their favour.

Agree llannerch, there's a very fishy smell to all this.
 
If the ownership is in dispute & the horse is safe and well I can only assume this has all been a hate campaign against a young girl.... I hope she keeps Old Tino after all I own part of him so should have a say in where he goes
