What makes a Bhs loan contract legally binding? i cant seem to find a decent answer on google so thought that their might be some legal ppl on here who could help.
Long story cut short is ive found myself in a very nasty situation with regards to my mare and i cant get an appointment at the solicitors untill monday.

so could really do with ppls experiences with it and if anyone knows anything that might be useful id really appreciate it :)

thanks i will give them a ring, even tho im not a member i will pay to become one,it would be easier i think. im afraid i dont want to go into detail on a public forum about whats happened incase it does all go to court :(

The BHS loan contract is only a template for a loan contract. Once you have ammended it you need to get it checked out by a specialist equine solicitor to ensure that it can be enforced and will stand up in a court of law. You should have at least two copies of the approved contract and ask both parties to sign and date it.

Before loaning a horse I also would suggest that youn ensure it is freezemarked on its shoulder so that it can be identified by anyone and also micro-chipped and passported if it does not have a passport. You should also ask to see a copy of the passport, driving license, rates bill and a utility bill of the person that intends loanbing your horse out. Photocopy them and keep them in a safe place. Also photocopy your horses passport. Take Summer and Winter photos of all four sides of your horse. Also on the www.nedonline.co.uk web site ensure that your horse is on it and that you mark it's status on it as being loaned out. I also advise that your horse is vetted before loaning it out so that both parties know what condition it is in.
