I remember a thread on here, updated several times, poster began with an S I think, sorry can't remember more than that.

the link below was the DM headline today. I just wondered if it was the same one as it looked familiar.

I feel sorry for them. They did searches and the council supplied details showing the bridle path was in a completely different place with houses between it and them. Now it runs right past their windows.

The council should, I think, pick up the costs of rerouting the path or compensate the buyers for their mistake.

That not far where I livery and is within longer hacks.

I've not ridden there but there are people around who have in the 60s and 70s and since then so whatever the definitive map said there was a case for getting it recorded through continuous use. They were told it was being used as a bridleway and they took a risk.

Little Berkhamsted 18 Bridleway. I am pleased to report that the inspector has confirmed the Hertfordshire County Council Modification Order for Little Berhamsted 18 Bridleway following a public inquiry in December and January. This follows the application in 2020 when the new owners abruptly closed the southern end of the route. We now wait for the County Council to advertise the inspector's decision. The advertisement starts a six-week period in which anyone can complain to the High Court if they feel an error of law was made. May I thank everyone who provided evidence.

Was it ex racehorse with the nutty neighbour who decided she owned the bridle path?
I had issues with the new neighbour who blocked the lane by the house. It had been missed off the map when updated in the 1970’s. Although she was fully aware horse riders. Joggers. Dog walkers etc would be walking past her front door. We had to get ‘user use’ evidence and submitted it to the council. This was during lockdown. It took a few more years before it even came to the table. Then a public enquiry as she objected. And was finally registered as an official byway last year. She then sold the house after the husband left.

Unfortunately for them it seems that the definitive map wasn't so definitive after all.

Some years ago we used to ride a bridleway that actually ran across some-one's garden between their house and tennis court. We always felt a bit bad about it and only rode it when the ground was dry so as to avoid leaving hoof prints in their lawn.

but the estate agent said he sold them it and repeatedly told them about the bridlepath, and although the map is wrong the statement on the map is very clear that is passes the house and mentions it by name.

They knew, and I bet they thought they could get it rerouted and got a nasty shock when they couldn't.

If buying a house with an in use bridleway, you'd want to check carefully especially if as in this case there is a variance between the definitive map and the definitive statement.

"Commences at Berkhamsted Lane at the extreme southern corner of O.S. 124 passing between Breach House and two Cottages to the W across O.S. 124"

Even it that section wasn't on the definitive map, it's accepted lots were left off, there is a process for getting them added if it can be shown it has been in continuous use. And the cut off date for them to be added has been removed.

Incidentally lots of bridleways round here go close enough to houses to look into windows. Sometimes there are highish fences but on horseback you can see over and comment on the decor. It's built up countryside with a lot of pressure on land by different users.

Horses were merrily using the Bridlepath before and when they moved in! They closed the Bridleway forcing horse riders to have to use a busy road.

I feel sorry for them too, in regards that legally due diligence seems to have been done upon the purchase of the house. The Council seem woefully inept, and I'd be chasing them for my legal costs.
The Bridleway was in daily use when they purchased the house so they knew it was there.

But observing it being used and it being a legal pathway are two different things. I may be being over generous I suppose, but like I said if due diligence was done legally when purchasing the property I can see why there would be this issue.
