Broke jockey door off horse box

Hi

There was a girl loaning my horse for while while OH was injured.
Mare was at a yard she chose and there was box parking. I asked yard owner if I could park box there and she agreed.
Horses were out 24/7 and was grand
When horses came in I noticed mare wasn’t being mucked out or being let out much (no turnout anymore bar turnout pen. Diy so you had to put them out) both yard owner and other liveries never saw loaner and from state of box wasn’t there much
I took over doing all the jobs and discussed with loaner
Said she would improve
Did not
So I decided to end loan
Before I talked to her she and her friend also at the yard
Text me to say they had washed my box. I didn’t think much of it other than oh that’s nice of them.
Orange wind warning came told loaner I was ending it. She took it bad decided not to have the notice and end immediately
Started to get horses ready to move
Went to see horse box and jockey door is completely broke off and back door also open
She left every door in it open in an orange weather warning
Now the jockey door is ripped off hinges gone door snapped at bottom and wood exposed and wet.
Then discovered she’s not been paying her livery!
So not only is she not paying the livery (it’s been over a month now) she won’t fix the box

Do I have literally anything to stand on here??

Oh no, how devastating. I also have no advice but BHS helpline sounds a good start if you're a member. Hope you manage to get the box repaired ok and not from your pocket and also horse away and safe.

I have no idea of the legalities but how can you even prove that she was responsible? If you don't have any reliable witness to her leaving it exposed to the weather I imagine she will just deny she left it like that. I am also wondering if you now have to pay the outstanding livery fees to get your horse back. I know it's loaners debt but I assume the livery yard owner will say and is legally able to insist the horse stays until they receive their money.

What a horrible position they have left you in what a total gobshite for sure.:mad:
 
I feel that the loaner is the one who owes the livery money, since she chose the yard, and she had the horse on loan as opposed to sharing. I would move my horse back to wherever they were usually kept and tell the YO to pursue the loaner for what she owes them. If pushed on it, I also might be inclined to point out that the horsebox was stored on their yard when it was damaged, and that there are now repairs to be paid for.

Were you paying to store the horsebox on that yard?
No payment I knew of them and now I’d say we are friends!
They also contacted me immediately when she wasn’t showing so I was able to make sure horse was looked after so love them to bits and kept me in loop about payments
 
I started paying the livery a week or two before loan was over as I felt horrible so she technically owes more but I covered it
And I stayed about a month extra paying livery off loan in hopes dept would be paid
 
I have the text messages of her apologising for the damage and she sent me a picture of her cleaning the box and doors where open during it
Horse is safe with me OH did a quick fix on box to get them moved but will need a new door tbh
Can’t use BHS in Ireland unfortunately
If she admitted the damage in a text, I guess you have a case.
