Hi, i brought a new horse on friday rode her and she was sound as a pound. got her home rode her again on sunday, and she was lame on her front and back legs she also crib bites.
i spoke to the seller who claims it was a private sale and i have no come back on him
i spoke to consumer rights and as the ad said 'can be ridden' 'vice free' i can take things further.
i then get a text message from the man saying that i knew the horse was lame and i advised him of this.....why would i buy a lame horse???????

i am so stressed out as i have a lame horse in the field and now cannot afford to buy another,

I have no idea what to do next!!!

he must be a dealer as he has lots of adverts with horses for sale, he is also a bsja jumper.

How could someone rip me off like that. why are people so nasty????
 
a dealer isn't just someone who sells lots of horses, it's someone who sells say x amount of horses over the year, every year. So if you can prove that they sold horses last year, and that he is running a buisness (ie if he's a livery owner, which is a buisness, and he sells regularly, then he can be classed as a dealer).
Someone else here will probably be able to help you more as TBH I know naff all about it, but I believe that it's the proving that he's running a buisness.

That said, I'm sure you can take individuals to court?

Did you have the horse vetted??
 
Oh poor you, what total nightmare. The fact that the horse cribs alone should be grounds for her taking it back - not exactly vice free then! Why on earth would you buy a lame horse!

I have to ask though, did you get the horse vetted?

I would tell the seller he has 2 choices, he takes it back and refunds you or you can do it the hard way and take him to the small claims court in which case he will still have to refund you but it will cost him a lot more.
 
Sadly there are unscrupulous people who just want to pass problems on and they see trusting people coming from a mile off!
What else did consumer advice tell you to do? If the advert says she is vice free and can be ridden then you have evidence otherwise but you may have to take him to court now and in the meantime you have care of the horse and expense. It does sound like the horse had been given bute before you bought her, why didn't you have her vetted?

I think you can start a claim on line through the small court and it doesn't cost that much.

Please, next time you are ready to buy a horse, take someone with you, 2 pairs of eyes and ears are better than one and don't buy from a dealer unless you have a recommendation that they are ok. I do feel for you.
 
If a private seller has mis-represented the horse you still have recourse.

I would put something in writing to the seller saying that you consider that he mis-represented the horse in relation to the lameness and the cribbing and that you would like him to take the horse back and provide a full refund. Tell him he has 7 days to get in touch to arrange the refund or you will be seeking legal advice regarding court proceedings.

Then actually get legal advice. You may well have legal cover on an insurance policy already, even if you didn't have it on your horse insurance you may have it on your home insurance.
