Can i get in trouble with vosa if .......

I agree with you persephone, i aslo do this but in someone elses post today, they mentioned something that made me think would it be seen as hire and reward?, would they say i need an operators license?.

If they do i think its silly that you can't help a friend, for example we had our lorry insured for myself and my husband, but changed it to any driver so my friend could drive it, to do this cost as extra £20:00, that doesn't bother me, but when talking to nice lady at insurance company i mentioned my friend had offered to pay difference, kind lady said i will pretend i didn't hear that as you would be receiving money and using your lorry as a business!!!
 
Well I suppose insurance can be a strange business.

What if my parents decided to pay my insurance for me? I don't see what it matter who pays what as long as the insurance is correct!

Probably a legal bod will correct me though.

I know of people who have actually bought a lorry together as a pool. How do they stand? The whole running costs bar the diesel are split equally between them. They each buy the diesel they need.

I can't see how ndifferent that it to your position. It's not like you can even register a vehicle between three people is it? Only one name goes down.

I'm going to shut up now, I have lost the plot!
 
Technically if you accept diesel money then yes, your are in a hire and reward situation which will also affect your insurance. However loads of people to this and I haven't heard of anyone being done for it.

yep thats what i would say! but yes you can get in trouble, there is some sort of certificate you can have to be able to carry other horses as my boss took it so she can carry other horses to shows to save lots of trailers from the same place going she just takes them in her lorry.

Below is a copy of an email I recieved from Chris Slowley, Senior O-Licencing Policies and Legislation Advisor at VOSA, last year. It was sent after I had asked for some clarification on the legislations and later was used as the basis for part of the H&H article. I think it might help with some of your problems and is certainly worth printing and keeping in your vehicles as a point of VOSA reference.

Where a horsebox is being used on a non-commercial (“amateur”) basis, we would not normally consider that the vehicle is being used for hire or reward where it is clear that the carriage of goods (in this case horses) is not with a view to making a profit. Despite the fact that the regulations don’t exempt private horseboxes from operator licensing requirements, VOSA would not take any action in situations where nothing more than "modest" prize money was involved. VOSA's aim is to enforce the law in a proportionate way.

In addition, VOSA will take no action where a friend's horse is being transported for nothing more than petrol money, purely to cover costs - and where it is evident that there is no commercial element involved in the transport. However, we would like to make it clear each case will always be taken on its merits.

Where it is clear that a heavy goods vehicle is being used for the transportation of horses in connection with a business or for hire or reward, VOSA will always consider enforcement action."
 
I wouldnt worry, hire and reward is hire and reward, even if you dont make a profit , after all we can all say we havent made any profit !
Vosa big as they are arnt the cleverest and all working in the same direction if you get my drift.
You only need a operators licence if you have a hgv horsebox - then it probably wont be worth your while , you need tachographs , daily checks ,six weekly tests.
If you get pulled <which seriously doubt you will> SAY NOTHING AND THEY ARE ALL YOURS
one department in vosa will tell you one thing.Another something else .
Taxi drivers say they never make money <but they do > but even if they didnt make any profit, they would still have to pay hire and reward insurance!
 
sorry forgot to add, if you have a non hgv horse box-for hire and reward, you will need a o-licence ,thats why self drive is popular with smaller boxs - a big way round it,they still need hire and reward insurance though!
