A friend of mine asked me a question earlier and I couldn't really answer it so wondered if you wise HHO's could do better than me....

My friends husband (really nice guy but been through hard time recently) has fallen behind in paying for an account. He is still making payments but they have ben reduced right down as he can't afford to pay the original amount (lost job) so he is paying what he can. Anyway the feed merchant is really being starchy about it (fair enough but he is trying and not just leaving it)

Well here is the question. This guy rents his house and the feed merchant is an old school friend of his landlord. Not only has the feed merchant told his landlord about this situation but he has now started copying the landlord in to any emails he sends to this guy.... Is this legal or does it come under data protection?

I'm pretty sure it would be considered against the data protection act, but would be more along the lines of a breach of trust.

If it affects his tenancy then I would recommend a solicitors advice.

I would also stop sending anything written.

See that is what I thought.. He quite a proud guy and it is really upsetting him as he did not want his landlord getting worried about him making payments for the rent etc. A bit sickening if you ask me..

Whilst I'm not a lawyer, it doesn't sound at all legal to me either! I think your friends should ensure they save and print copies of these mails to prove that the feed merchant has been 'copying' extra recipients into the messages so that they have evidence that can used if they need to seek legal advice.

I agree with the previous posts that going to a solicitor may be a good idea to get their opinion on this situation, because you never know what repercussions it might have on the house rental. They shouldn't have to pay to do this either.

What a horrid situation, some people can be so awful. Hope it all sorts out.
