My son is in the process of renewing his car insurance and asked why he was not getting a reduction as he has not had an accident.

It transpires, that someone ran into the back of his car and did very minor damage - it was a small bump. He was only travelling at about 5mph and did not make any claim for damage to the vehicle. His flat mate who was in the car, without his knowledge claimed for a non existent whip lash injury and was paid £2,500 in compensation.

He knew nothing of this as the insurers, Admiral, did not contact him at all.

I think the flat mate is guilty of fraud what do you think?

I had a problem with a claim from Admiral (they put a chip in my windscreen as a claim) I had a word and they sorted it very quickly.

Call them and say that you weren't contacted and that it should never have gone through without a chance to contest it.

I always phone a few numpteys and hang up til I get one who will help, there are a few brillliant people on the end of Admirals phones

Also in this case it should have come off of the other parties car as they caused thye 'accident' so push that point too as he's wrongfully claimed.

Absolutely shocking - I can't get over the way people claim for non existant injuries.

My Dad and I were in a crash in February - Dad pulled out into fast lane (after checking all was clear) and was tailended by a car full of young lads. They caused us to spin all over road and nearly tip over. My life flashed before my eyes, I can tell you.

Anyway, we were ok, though Dad's car was a write off. Their car had slight damage to front bumper. I called an ambulance to get Dad checked out (he is late 70's). Nothing wrong with lads. We had witnesses who said they were driving erratically and accelerated into us.

So, three weeks or so later, Dad finds out all 5 of them have claimed against his insurance for injury! I suffered from chest pain for around 5 weeks and Dad was stiff, but just not us to claim.

Dad's insurers were very good - they eventually sent out an investigator who says he sees this all the time - they do this deliberately!!! They could have killed us! I last heard they have found that it wasn't Dad's fault, so hopefully not effect his insurance - so that should be some comfort to you OP.

They might well get the claim money apparently as it is easier than taking such claims to court, but the investigator reckons they will be blacklisted for insurance from now on. I hope so.

If the accident was the other party's fault and not your sons then the claim should have been against them. Your sons flat mate may well have dealt with Admiral in the first instance but it should then have been up to Admiral to pursue the third party insurers.

Did your son swap insurance details with the third party and report to his insurance company at the time? If so then I would be contacting Admiral and asking why they have not pursued the at fault party.

Sadly, it just highlights the need to inform the insurance company of even very minor accidents. In my Admiral (and previous policies with other insurers) there is a clause that says I have to report anything that may result in a claim. I would also always swap insurance and other details even if there is no obvious initial damage as you can never be too careful.

In this case I would say that Admiral have been very harsh if they know that your son was not at fault then any claims made by his passenger are not his fault.

I know there is a huge compensation culture but in a way that's a separate issue to the fact that in any case the claim should not be your sons to bear.

How has the flatmate got hold of the insurance details?

Why is Admiral paying out without even speaking to the driver to ascertain what happened?

And no, your son should not be bearing the cost!

Did your son report it to his insurance company and give his passenger's details to them?

I had a very minor accident in February when my car was hit by the car in front reversing into it at a very low speed. I rang my insurance company who wanted to know if I had any passengers and their phone number. My daughter and grandson were in the car and even before I had finished my phone call they had contacted my daughter and were very insistent that she should claim for whiplash injuries. We were both very cross about it as it was a very low speed impact, no airbags inflated, but they rang both of us several times and wrote to us trying to get us to claim, at one point even mentioning a figure we could hope to get paid!!

And no, we didn't claim but I can see how tempting it would be so perhaps your son's flatmate was easily persuaded????

Is the flat mate named on the policy or authorised to speak to them- as if not surely insurance co are breaching dpa by not speaking to auth'd person?
