sorry just had to post this to get other ppls opinions
i answered some one on here just over a week ago about a dealers yard local that they wanted opinions on.
i asked the person to pm me which she did and i answered her truthfully and from my own knowledge not third hand etc.
iv just looked at my messages and hey guess what the said "dealers" pmd me saying i wrote deframotory post and they had reported me to admin and their legal team!!!
now correct me if im wrong but i thought a private message was just that private. i didnt slag them off on the forum and id already months previous posted on here about my problem horse ,and never named them as im not that stupid
i do beleive they do this on a regular basis (pm ppl that have commented on them) dont think thats good for buisness

basically i cant see the point of ppl asking for others advice and personal experience on subjects if we cant give an answer

I guess the person asking for the advice was the dealer? I wouldn't worry about it, if it was all factual all it will do if it went to court would be to highlight how bad they are. So they would have to be really stupid to do that. Legal Team - as if!!! Although maybe they need one to cope with all the people who complain about them.
 
I think we agree not to defame etc. in PM's, but it does seem somewhat underhanded of the person you answered, presumably a connection of the dealer. How unpleasant of them. Do you feel able to say who you replied to?
 
the person i answered on here is genuine im sure of that!!
just think the dealers are takin a pot shot as they commented on what i wrote on the forum not in pm message (not that i wrote anything wrong)
however have to say i coudnt contain the urge to pm them back with a little sarcasm

im mostly annoyed that i cant tell ppl the truth as i see it from personal experince what the hell happened to freedom of speech then?????

Don't be naive....you're no more anonymous on here than anywhere else.....
 
You're not legally allowed to slander (speech) OR libel (written) people, technically speaking. The catch is the internet is considered "publishing" - it is not the same as having a private conversation with someone - and, as pointed out, it's far from anonymous. Saying something defamatory about someone on a bulletin board is pretty much the same, legally speaking, as publishing it in a newspaper. (I'm not at all sure of the legal arena of private messages. Perhaps they are like mail but I suspect they might also be considered publication.)

The catch is the law is always in flux and it barely keeps up with the technology. Much of the time laws aren't in place to cover a situation until someone actually launches a suit or presses for legal recourse.

Increasingly bb's are well aware that their members might behave in unlawful ways and that they might be held accountable. That's partly why you agree to the terms on here - so if you get in trouble HHO can say you were warned and moderate their own responsibility. (Apparently the easiest defence is not to moderate AT ALL and to just make every person take responsibility for everything he/she writes.)

You're right, unless they know what you said they are likely fishing (unless you implied something in your original post). But even then if they saw, say, a printout of what you PM'd that might be a grey area, to say the least. If you can prove your allegations that would work as a defence but you'd still have to prove it if pressed.

You're probably not in trouble BUT they aren't joking when they say they have grounds if you've impugned them on the internet. Publishing is publishing.
 
It is not considered slander (well libel if we're going to get technical) if the statement is true. So if what you have said can be proved to be true then you have no problem!!

However, saying they have a legal team is bull, they have no legs to stand on, and they would be stupid to even bother!! Cases of this type never go very far, and often would get laughed at!!
 
Have had a similar experience and had my posting removed, but not before people who had similar experience to me had seen it and let me know I was not alone...it also really helps to have good contacts who can work on your behalf, and I did have to start legal proceedings to get my money back which is why I put a post on here about purchasing advice. Besides, if it does not do what it says on the tin its false advertising and a trading standards issue...there is a dealer that keeps getting done for that isn't there...bombproof something or other or whatever they are called now...4 name changes last time i heard

I am the person who asked the question and live in Norway, so I really have no connection to the dealer in question!

I appreciate the advice given to me and understand people answered me at the risk of upsetting someone so I am very greatful that I was stopped from making a potential mistake. I wish I had checked the forum earlier to explain myself!

Due to the advice given I left well alone and have now bought my perfect BWB mare who has passed a 5 stage vetting and is exactly as described. (bay in sig!)

Imagine if the people who warned me off had not and I had bought a bad un... I would have been absoloutely gutted, a huge thank you to the brave who are prepared to speak up against bullies!
