Am trying to buy a horse which is not aval til end of Oct. The seller wanted me to have horse vetted now and take home then. My vet and I are against this part since horse being used in school. Date arranged on day Horse ready to go but now seller asking for non refundable deposit ie. if horse fails vetting we lose deposit and if we dont pay deposit seller will put horse up for sale, since I am ready to buy now it seems a bit harsh that I am being treated in this way. Any advice please

NO NO NO!

Deposit is returned if horse fails the Vet! Don't accept anything else. If the seller won't do that, she might be expecting it to fail!
 
This sounds totally unreasonable and very dodgy - do not agree to it! At the very least, have it in writing that you have the deposit back if the horse fails the vet. You are absolutely right to have it vetted at the time of purchase and not now.
 
This horse isn't based in Gloucestershire is it?! I had a similar situation a while back...I walked away however as there was too much dodgy arguing from the seller. I think they expected the horse to fail the vetting and so wanted people to pay a non-refundable deposit in the hope they might take the horse anyway!
 
The seller is being unreasonable & also being incredibly stupid. Due to them making unreasonable demands they are going to lose a sale. There are loads of horses out there at the moment for sale, it's not that easy to find buyers!

Your vet is right about this, tell the seller that you want the horse but only if it passes vetting when it is available. If they maintain this ridiculous stance then walk away. It's their loss.

I've just put down £250 deposit on a horse which is only refunable if horse fails vetting which it didn't fail

which is pretty resonable but I wouldn't put a deposit down that I wouldn't get back failing a vetting
 
Absolutely not.
The vetting needs to be done just before you collect, anything could happen between now and then.
A deposit should always be refunded on failure of a vetting, it's not a legal thing, just a common sense thing.
