Deposit on Yard please help:0)

Hi can anyone offer advice? We recently put £100 as a holding deposit on a yard. The horse we hoped to buy fell through and we are still frantically looking for a lovely new pony. We were contacted by the lady at the yard and were told that she had other people interested in the yard. We could keep it but we needed to start paying a weekly fee. We replied and said not to worry and we completely understand and to let it go to someone else as we do not know how long it will be before we find the right pony. She has now said we are not entitled to our deposit back. Surely if she has broken the contract with us we are entitled to a refund? Any advice would be greatly appreciated we are feeling sad with no pony and no yard and now money down ;0(
 
Not sure she has...she gave you the option to pay for it, therefore keeping the deposit and stable as arranged, but you didn't want it....I'd expect to lose the deposit I'm afraid
 
I dont think you are entitled to the deposit, you would only get that back if you took up the place at the yard. It was there to compensate the YO for the initial period when you werent being charged holding rent but neither were you paying for livery but she couldnt let the box out to anyone else.

sorry to be bad news but having been charged deposit and then holding rent in the past I wouldnt have expected to get either back if I didnt proceed with taking up the livery place.
 
No you are not entitled to a holding deposit back, otherwise what is the point in charging it? I only give it back if people actually come to the yard and knock it off their first month's livery. The lady has been out of pocket because she may have rented it to someone else in the meantime.
 
How long had you had the stable on hold? If it was only a few days I think she perhaps could have refunded some, however if its more than a couple of weeks, then fair enough - thats what she would have earned from it...

I would just tell people to pay for the stable anyway if they wanted it.

under what circumstances do you think the yard owner would be in her rights for keeping the deposit if not for if you back out?
think about it. Im afraid this is exactly what a deposit is for.
You should however, both have agreed a moving in date or the length of time the holding deposit was good for before rent started to be payable.

i cant imagine this was just left open ended?

If someone asks me to hold a box on the yard, I charge them a holding fee or a deposit, depending on the length of time we're talking about.

If someone paid a deposit, and then was in your position with no horse to fill the box, I would do exactly as the YO has done. I would offer the option of paying the weekly fee to ensure the box was held for longer than the agreed period, and if that was not taken up, I would retain the deposit.

Why should the YO be out of pocket? She could have filled that box and been making money on it rather than having it standing empty waiting for you, so she needs to retain the deposit and compensation. That's what deposits are for.

It sounds like a real bugger of a situation though, I really hope you find a lovely horse and that it doesn't fall through this time.
