We have a small DIY livery yard.

Just recently on of our liveries has started to advertise and give riding lessons to children on her horse.

Does this mean that if one of the children had an accident riding her horse that we (as the yard owners) would be held liable and parents could sue us etc?
 
I thought that if you recieved money for such service as horse riding you needed public liability insurance etc. If she is registered as a freelance instructor again, she should have her own relevent insurance that specifically cover her for this -I know if it was my DIY livery yard, I would gently remind her that the clue is in the title, i.e not riding stables!
 
DO NOT LET HER DO THIS. You as the yard owner could be deemed liable if the child has an injury on your premises. Is she insured, are you insured for other people riding on your yard. I would stop this immediately. If she is makeing a living from your yard then she should be paying you for that privilege of using your facilities so I would be charging her £10 per hour to use the school. Cheeky woman - to do it without asking!
 
I'm fairly sure as she's using your premises even though it's her horse you'd be verging on being classed as a riding school, all riding schools have to be registered with the local council, and you'd need puplic laibility insurance to cover the teaching.

So all in all it's very cheeky of her not to ask and potentially could make you liable in case of acccident and your insurance obviously wouldn't cover it so it could ruin your life completely, so you'll have to put your foot down immediately!

I think it would be fine for her to teach other liveries at your yard on their own ponies/horses (as they've a right to use the school anyway) ditto she could teach other kids at their own premises either on her horse or their ponies, as then it'd be entirely down to her to sort her own public liability insurance for doing so, and there'd be no onus on you as YO.

Edited to say I think you should put in writing (and keep a copy) that she has to cease with immediate effect, suppose little Johnny fell off...
 
I agree with Dubsie if there was an accident you could be held liable and your current yard public liability insurance may not cover for her teaching as this is classed similar to a riding school insurance not livery yard. For your own peace of mind ask your insurance company.
 
if she is insured as a freelance instructor, then she should know that a freelance instructor cannot supply the instruction and the horse as that constitutes a riding school and needs a different set of liabilities and inspection and registration., however as a freelance instructor she is covered for public liability to teach anyone on their OWN horse at their home or yard.
