diy problems and yard owner

hi, require advice, am on a yard where i keep my 2 horses, yard owner is useless, other person at yard has 2 horses, dosent have insurance, lack of concern and safety of other horses. doesnt call vet when horse is injured, which has been for weeks as she didnt sort out problem, now horse has swollen leg that vets are struggling to heal.
aggressive women who actually attacked fellow horse owner and yet yard owner states she isnt gettting involved. she seems to say this on evertything. she has notes up over yard stating she is not taking responsibilities for anything and she dosent. does she have a legal responsibility to us and our horses. ? also our cars are parked on yard and this said womens horses are constantly breaking loose,where would we stand if they ran into our cars. when the said horse was well she was giving riding lessons on it, not insured and was being paid for it, again is this allowed.?
she did have a horse that had to be put to sleep due to her blatant neglect, the yard owner knew this.the rspca have now been informed, we need advice as our horses and our safelty are at risk.please any advice .
 
I would be looking to move asap! I wouldn't stand for that from anyone and you are fighting a losing battle with the YO having that attitude. I have moved in the past for similar reasons and wouldn't hesitate to do so again if the situation arose. I am incredibly lucky where my horse are now though, as they live where I live, though I don't own it!
 
denise, your yard owner does have a responsibilty of care tho limited if only DIY liveries. she must have full commercial liability as the land owner. as a DIY yard doesnt require 3 c liability (care custody and control). cars are usually parked at car owners risk but it would seem logical that the yard owner takes responsibility for fencing stock. if the other livery is giving lessons on her horse (for financial gain) there are several questions that spring to mind? has she got freelance instructors policy incl liability? if supplying horse and lesson then she constitutes a riding school? (a different set of liabilities aand insurance and has to be inspected). YO is partially responsible if allowing this at her premises. YO has a llarge proportion of liability as she is offering livery (allbeit DIY) as you are paying her (financial gain therefore business) for your livery. have you got any form of contract?
 
Frankly it doesn't matter if something is against the law or not, or if the YO has a duty of care or not. If the YO can't be bothered to look after his/her yard & allows the things you have said to happen then your best course of action is to move. Things will not improve as the YO doesn't want them to. They appear to be someone who just wants the rent & doesn't want any other involvement. As others have said...Move yards.

Just move if you can. had a problem with YO, I moved and horse and me are loving it. It was a nightmare. Wont go in to detail. That was 17 months ago and I have never looked back. Its just not worth the hassle.
