Do we need planning permission?

We have asked the local council, however the answer didnt satisfy my OH :D so I'm on here asking again!

Some 15years ago, planning permission was granted for two stables and a tackroom. This has now been taken down and relocated. We are now looking to put back two stables and a tackroom, albeit a slightly different configurement.

*Old set up was two standard stables and a little tackroom
*New set up will be one standard, one foaling box and a tackroom.

This will all fit on the existing concrete base that the old stables were on.

What do you think?

My OH is an architect who does this kind of work all the time - he says unless you have only very recently taken down the other stables ( in which case you might be able to say you were repairing them) the planning would have expired when the previous buildings were taken down. So yes, you will need new planning.
 
Yes.

I've also heard that just because permission was granted previoulsy, it no longer means than you will get it again, which used to be the case.

We had our stables built four or five years ago, and our stable builder says that plans now have to be much more detailed, showing where muck heaps and drainage will run to etc.

Good luck. I hate planning depts! Sometimes I think you should just do it!

How long ago was the original block taken down?
Does it appear on google earth / maps or any other satellite imagery?
Is it in a place where it's visible to passers by?

If it was taken down so recently that it still shows on sat pics and no-one is likely to have realised it's gone then I'd be inclined to put it back as it was when viewed from the air but have "moved the internal walls" if anyone asks.


And yes I do know that's not the technically correct answer.
 
once you have planning i dont think it can be taken away unless you do not start the job (this can mean just turning the sod [lol] ) within 3 years.

i think the crucial point here is did you put in planning the relocate the building?if not then i would have though that you would be ok but that is only imo
 
Yes, you need planning for any erection of building that doesn't satisfy Permitted Developement, regardless of whether or not there has ever been any thing erected there previously.
 
Hey all - I totally agree that it does require planning, obstinate but lovely OH does not :)

The stables weren't actually demolished, just dismantled and then put up elsewhere. They belonged to his sister who has now got them on her land :)

And as for trying to exploit the loophole of whether it appears on maps etc, we have some dreafully fun neighbours who despite buying houses next to a farm, seem to really begrudge farm activities - so they'd get one whiff and make sure someone knew the stables havent been there in a while - so we'll just cross the Ts and dot the Is anyway :)

Thanks guys, you confirmed what I thought - the lady in the planning dept was in fact telling the truth (not a naughty lie to lift money from my OH's purse lol)
