Does anyone know anything about schedule 14 Right of Way applications?

We are (still) looking for land to buy, and have found somewhere hopefully suitable. However on an OS Map it has a "Schedule 14 application" which shows as a path down the side of the field. It isn't a public footpath or bridleway, and on further digging it seems that in 2005 some randomer applied to have it made into a byway open to all traffic. There doesn't seem to be an outcome for the application (it says "undetermined“) - woukd this out you off? The land otherwise it exactly what we are looking for!

I think I would take the chance. It doesn't sound like the sort of thing that will be likely to get approved and it was 17 yrs ago so whoever applied hasn't chased it up. At the worst you could just fence it off. We have a footpath down the side of our field which has a similar application in. I don't think it will get passed, we have put in objections and nothing has happened yet but if the worst happens we will just fence off the minimum width we are allowed to with a high secure fence.

Thank you, yes that is what I'm thinking, it wouldn't be ideal but not a deal breaker, but would rather it wasn't there in the first place! I will chase it up with the County Council I think and see what they say about it.

It wouldn’t put me off if the price was reasonable. I’d want my solicitor to investigate it though, just so I was buying with my eyes open. Common sense would suggest something more would have come of it by now though if it was a viable application. Might be worth finding out what the process would be should someone show an interest again now- could it be re-looked at or would they need to start again for example? Might help you to weigh up the level of potential threat?
