Equestrian Clubs & Licensing??

Does anyone know if it legal to borrow ponies, form an equestrian club with a membership then give riding lessons without getting a license?
Apparently this is happening and the insurance is far less than running a riding school.

I did some work experience with a vet in 2001 and this was happening then - he said a lot of riding schools were becoming "equestrian clubs" as it meant they did not need licensing and insurance premiums were much lower. I'm not sure how it stands today though.
