FAO - Yard Owners, Advice Please

Hi,

this post is aimed at Yard Owners and those with detailed equine legal experience please.

Some may remember I posted a while back about rehoming one of the full grass liveries horses (large, unsound mare, ‘owners’ no longer want her/to pay for her). Well, I’ve just had a call from the ‘owner’ who normally pays the bill whereby they said that they don’t actually own her! Apparently they agreed as part of a business deal that they would lay for her upkeep, they no longer deal with the owner, and claim that they cant get hold of them. Sooooo, it seems I am going to be stuck with a horse, that I cant do anything with. Does anyone know the options? I’m not going to rehome a horse without the owners knowing! But at the same time, the current people who are responsible no longer want to be responsible, they are the only ones we have ever had dealings with. IMHO, if they agreed with the owner that they would pay for her upkeep, they should keep to their said of the deal but I guess that wont be happening. Its so annoying as they don’t pay full charges anyway despite her size! (it went up to £15 per week in Jan for her rent, plus hayledge/feed at cost when she uses it, farrier they pay, I do all of the looking after out of the goodness of my heart!)

Any advice or suggestions on what parts of the law i should maybe be investigating?
 
Do you have a contract signed by these people? Your written or verbal contract is with the people who keep the horse with you, not the owners. I would send a recorded delivery letter stating that monies owed should be settled within the next 14 days otherwise you will have no choice but to take legal action. This can be done through the small claims court.
 
the problem is llywycwn, they just dont want to be responsible anymore, so sooner or later i am going to be left with said horse (which is some ways i dont mind as i am really fond of her), cant contact owners etc
they have paid the most recent invoice, but seem to just want to stop now they have said they no longer want her.
 

Even though they no longer have 'dealings' with the owner, surely they can tell you the name and address of them? You can then get the contact details and contact owners and have her signed over tou you to sell on or do as you wish with?
 
The horses carers have a contract with you. Therefore they are responsible for the bills. Don't waste any more time and simple go on line and take them to the small claims court.

If the owners give you the full name of each of the owners and their last known address then it should be easy to trace them. if they actually exist! (Contact me for help).
 
TBH, i dont see what i could claim with for the small claims? As long term, this horse needs to be paid for long term or find a new home. They are claiming that they have tried to contact the owners with no luck, i had asked if they have written to them and they are saying the cant trace them.. and dont know where they have gone.. not 100% sure if i believe it all, they are not horsey at all, and we have known this all along and we knew that there was some issue hence they had been left responsible for the horse, but now the story seems to be changing.
Yes, if they dont pay i could claim the horse etc, but its not their horse, plus she is worthless so monies owed couldnt be taken from her sale. besides, she isnt theirs ?
