Feeling Bad - Pointless Post

Yesterday I sold one of the livery horses I have on my farm on behalf of her owner. The buyer gave me cash for the horse and I gave her a receipt for the money. I phoned the owner to let her know the horse has been sold and she came up today. I gave her the cash and she gave me the horse's registration papers.....and then she gave me the board money for next month.

I have a clause in my T&Cs saying that you have to give one months notice of leaving, hence her giving me next months board for no horse. I have to say I do feel guilty taking this money

. I said to her to come up and ride some of my horses and she said she'd love to and I'm sure she will as she loves riding my guys.....but taking the rent money seems not right really.
 
to take the money when the horse has actually been sold seems rough to me....if she had just turned up and decided to take the horse away, then fine, but if its been sold, i cant see why you would accept the money in the first place! i'd give it back!

You shouldn't feel too bad. I mean you do have a business to think about at the end of the day. Say you let her off the cash for next month then the other livery's decided to leave and dint pay up....You could be left with a problem. You've offered her to ride your horse's i think that is good will enough.

Should I have taken commission for selling the horse and charged her for the cost of the adverts I placed and the cost of my time for showing the horse to potential buyers?
 
I think you have to apply the rules the same as you would to anyone else who was leaving. It's not fair to the others otherwise, and if you start making exceptions you could open a can of worms.
I understand how you feel though, I feel your suggestion of coming up and riding other horses is a good one.

to be fair, Tia, your OP didnt say anything about the circumstances under which you were selling the horse. if you wanted to take commission for selling her (which i think you are well within your rights to expect) then why dress it up as 'next months board'? just be straight with the owner, and take the money for your time/expenses!

I was going to ask if a fee was charged for the selling the horse if it far out weighed the months livery,then fair enough,as they say there is 'No such thing as a free lunch!'

Well if I had charged her sales commission at 10% (which appears to be a figure used in these parts), then she would be owe me another $50.

dont beat yourself up over it, T&Cs are there for a reason i guess. when we moved Ellie from my friend's yard, we left in the middle of the month, and still paid up for the two weeks we weren't there. just keeps the status quo, everybody knows where they stand!

Sounds like you did her a favour regards to selling the horse for her, its the sort of thing i would do for one of my liveries. But at the end of the business is business and it sounds like it was an understood contract on both parties, even if nothing was signed.You do have to set a stall somewhere for all your boarders.

As its in yout T&C's then your are within your rights - she knew she had to pay.
she could have given notice 4 weeks ago and prayed the horse sold in that time! (yup - ive done that!!)

I think letting her have a couple of sits on yours is a nice thing to do without having 'double standards' in the eyes of your other boarders.

Yep; it seems that it is an even more pointless post than I first thought. She has just phoned me to ask if she can buy one of my horses; I don't want to sell him till next Spring but have offered to loan him to her for a few months to which she agreed; so everyone's happy now.

If I was in your clients position it wouldn't occur to me not to pay the months notice, horse or no horse, I daresay most people would just shrug their shoulders and pay up, that's what contracts are for. (Unless you happen to be the weasly little slimeball that is trying to take me to Court because his girlfriend couldn't ride a Milton Keynes cow let alone a QH)
