if you had a golf course next to your property and your roof sustained a damage would you expect to have to mend it yourself?

The golf club should have insurance for that sort of thing-I used to work at a golf club and we had to pay to get a windscreen fixed. Although that was on the property so that may be different?

Guess you just have to be quite firm with them-They probably would fix it for a quiet life!
 
My OH plays golf and his course has quite a few footpaths (and I think even a bridle path) running along its boundaries. I think members are advised to have insurance to cover them in case they hit some passer by. He certainly has cover and I think most of the people he plays with do too. I would have thought damage to property is exactly the same, and if they can't trace the golfer in question then surely the club should be responsible for sorting it out as they must have some duty of care towards their neighbours? I would go and talk to them. Its would certainly in their interest to keep their neighbours happy.
 
The player would likely be liable but if not identifiable or not insured the golf club MAY be liable. Not to prevent people playing golf in the future, but more likely just the cost of the damage

NB Im not a lawyer but from what I have read the club would need to sort it out. If they dont want to be saddled with that they can insist that all players take out the widely available golf insurance policies before playing.
 
Does it not depend on which was there first, your property or the golf course?

Not in respect of the damage according to the case law. Golf course being there first does mean they have the right to go on playing (taking all appropriate practical steps to try to prevent probs eg nets, trees etc), but it doesnt affect liability for damage caused by the activities however lawful of their members by mis-hits (see the case quoted above)
 
my property and the small golfcourse (9 holes?) came into being about the same time.
it is a small course used by people staying at the b&b and i think others use it and make a donation.
