Hi all,

I know we are not allowed to discuss ongoing court cases for obvious reasons but i am wondering if any one has ever (in the past) sued a dodgy seller?
 
I haven't sued, but have taken a dodgy seller to small claims court and got all my money back plus livery and farrier bills.
 
yes they have and there are cases on the internet. The key to success seems to be if the horse was advertised and you have proof of purchase. There seem to be dealers who have been succesfully sued and still trading and some quite serious stuff. Its so easy to talk in hindsight but something as simple as putting the dealers name into the search engine might bring up some surprises. A common one is the three month guarantee...... which is never honoured!!
 
My friend bought her horse through a well respected dealer, she is often mentioned on here as being one of the better ones. She was selling this horse on behalf of the owner.
The horse turned out to have all sorts of things wrong with it and the owner knew, but the dealer didn't.
Unfortunately there was nothing my friend could do even though her horse insurance and house insurance were happy to pay her legal fees.
She ended up giving the horse away :(
 
One of my friends has gone down the Small Claims Court route. It has taken nearly 2 yrs I think, and getting the money out of the dealer has been tough even though she was awarded refund of horses' price, plus other costs.

Even 'winning the case' doesn't guarantee you get your money. She had to hire private bailiffs.
