Having to repaint an entire stable to get livery deposit back?!

If you paint choice words on the white part with white gloss and then emulsion over it the words will appear over a few weeks -not that I'm suggesting you do this of course.

Unless in a contract you should not have to paint but leaving the stable clean is a normal requirement and the usual reason for a YO taking a deposit. (liveries that leave in the night leaving a big clean up for the YO )
Fair wear & tear is not a reason to retain deposits and your rent should pay towards keeping the yard maintained.

Do you pay livery in advance?

Out of principal I would not let him get away with it nor would I paint his stable, he's trying his luck.

There is no reason why you should not request your deposit back and not paint his stable, and sorry to say your family should support you not allow this bully to win.

Don't mark the letter "Without Prejudice" whilst it may "make it look legal" to someone who hasn't got a clue it will make it entirely clear that you are taking legal advice from the internet and not from a qualified lawyer.

Marking a letter without prejudice basically means that you cannot rely upon it in court, it can be useful if you are making an offer of settlement but if you are writing a formal letter before action you need to be able to rely upon it in court.

Having said that I wouldn't issue a small claim for £150, it wouldn't be worth the time, effort and stress. I'd be far more inclined to use other means to exert pressure......
 
Go to CAB and see where you stand. I really think from your posts that even if you did go and paint the stable, you would be whistling for your money back. There would be more excuses not to pay you...

And while I really REALLY love the idea of the words in the stable.. it is obvious and immediately traceable to you and as said before, the words "criminal damage" spring to mind.

I would try CAB, try the letter route and if no joy, then ask if this additionial money will be declared on his tax return? and that you will happily notify the tax office if he can't be bothered?

I have asked liveries to leave asap , also months notice etc.

I would NEVER ask any of them to paint the stable. EVER



Sometimes they clear it out sometimes not.

once a livery gives notice I stop putting shavings in during the next 4 weeks and muck out generously so once they are gone its easy to clear the rest out, I normally do this not the livery unless they want to take it with them.


DONT PAINT IT .!!!


go to a solicitor ask them for advice. gather all your paper work , record all text messages etc .

You need some professional advice on this one photocopy everything let solicitor see it . Get a form from small claims court as you might need to take her there if it goes that far. How much is deposit??



If low as in under 100 i would just forget it if not she could end up paying court cost and your deposit.

Have you got some big blokes you can take with you to demand your money back?

Being civil to this tw*t is obviously not going to work - sometimes things have to be sorted out the old school way.
 
Sorry for the delay guys, ive been out trying to forget about the whole saga of this.
I actually told my mum not to talk to me about it for the next few days because im so torn over it all.

Me and mother are going up tomorrow to disinfect the stable floor and walls- the stable is already cleaned out/swept etc.

Ive decided to disinfect it as although i had asked originally and was told not to, he said on the phone he now wants it done and of course, i have no issues with this. Regarding the painting... Im still in two minds tbh. My mother has stated we can just do some small 'touch up' painting so that it smells like we've painted and incase he decides to check the walls will be wet but we wont make it perfect etc.

ahhh, im still thinking this is giving in to his pathetic power trip.

Ive tried ringing CAB all day- its like getting blood from a stone i cant speak to anyone.
 
Disinfection is not your problem.
Neither is paint unless your horse has done substantial damage not just wear and tear in the time he has been in it or you have repainted it?
Send them a recorded delivery letter demanding your deposit back. I wouldn't have left without it.

I didnt have a choice, they are a couple and the woman (who clearly doesnt know her a$$ from her elbow) told me that they send out a letter regarding the deposit within 7 days and as i know i didnt owe any money and my stable was swept out and tidy i assumed that this would be a pretty easy conclusion of just getting my deposit in the post. She then stormed off after locking us out the yard waiting for the transport on the main road.
 
In future get a written letter saying that all monies owed are paid that nothing is owed and your deposit will be sent in due course-then they cant do the 'but you haven't done htis'. Have you got written confirmation that your deposit willb e paid once stable is done?
 
Use the small claims track in the County Court, it's easy. You can also claim the fees and reasonable expenses (but be aware that you can't apply online if you claim expenses other than the fees). I did this because of an expensive repair to a second hand car and got a cheque from the dealers last week for pennies less than £1700 :D Which is a really good resource to find out how to do things in the right order.

I know £150 isn't that much money but it's the principle of it...and remember revenge is a dish best served cold. Vindictive, moi? I'm much worse than that :D

Take a camera up tomorrow and take date stamped pictures of the stable once disinfected. Then ask for your deposit back but do everything in writing. That is vital.
