Help Advice needed.

This may seem a dumb BUT. Where I keep my horse,the man owes BT £56.00 and is refusing to pay it,so now a debt collecrtor is involved.
IF it went to court and he didnt pay it, and if the Baliffs came out,could they take my horse its kept on the property? Im worried sick! Horse is microchipped.

They CAN take animals but as has been said, the horse is not his.

However, I would be inclined to speak to CAB to reassure yourself.

Is there any chance the man would tell debt collectors that your horse was his?

A debt collector has little power without going through the proper legal chains, e.g. courts. I would doubt this debt was worth persuing through courts as its so small. Plus if he has a genuine arguement for not paying then his case needs to be heard in a small claims court. As long as he stays in contact with the debt collector you shouldnt have a problem.

He would NEVER tell them the horse is his,hes a friend of the family. He is refusing to pay BT because His phone hasnt been working for a year and they told him theyd drop the charges. BT didnt change the phone name over to his,so the bill is in his deceased step mothers name.
I dont see how they could take my horse as you said I DONT OWE THE MONEY.Hes a old man.They could take hid dog tho.

As long as he explains the above to the debt collectors I'm pretty sure they will stop persuing the debt, its so small, its not worth their time. Plus its in a dead womans name, the line doesnt worrk, all good cases for him not to pay. Its when you ignore debt collectors you have a problem, they are normally reasonable people (well, most).

I have heard baliffs can take animals to pay off a debt but the item or animal has to belong to the debtor.


Your items and horse is safe as long as you can prove they are your and you are not pretending they are yours!

It sounds like this man should be the one talking to CAB or similar, if BT are sending the baliffs out over charges for a service that hasn't even been provided! Esp if he is an older man - sounds like BT are taking the p*** TBH :(

But I doubt they would want to be taking any animals! Way too much hassle for them and little money in it so I wouldnt worry about that.

Firstly, I would really, really advise him to visit Citizens Advice himself, for some support with getting the argument with BT sorted out. They are awful to deal with, even when you are trained to do so :eek:

For you, as others have said, he is the debtor. Your horse belongs to you, so is safe.

It's worth bearing in mind that anyone who visits the premises at this stage are just debt collectors, NOT bailiffs. They have no more power than you or I to do anything, although they generally work on commission, so know how pushy they can be :(

Basically, a bailiff could only come out if BT take him to court & get a county court judgement (CCJ), which he then doesn't pay. They can then apply to the court to allow bailiffs to attend.

Thankyou so much for putting my mind at ease. I went up to see him today and apparrently he went to the phone box and now BT say they have written the debt of £56.00 off (we'll see) I said to him,you should get it in writing. I also talked to CAB this morning,and they said I could give him a photo copy of my bill of sale,passport and also the loan agreement for the little mare. I was panacking. So hopefully this is the end of it.

Yay! I'm so glad it's getting sorted for you both :)

You're right though, he definately, definately needs to get it in writing from BT, that the debt has been written off & no further money is owing. Just in case it ever becomes a prob in future. I'm sure CAB would help with this, if he wanted.

Hope it is an end to it all for you :)
