help-land my horses are on is going to auction

I am renting a 7 acre paddock with stables and I only moved my horses there in october.
I was flicking throught the local paper and I saw a picture of my land with my horses on and it is going to auction in less than a month.

Where on earth does this leave me??? I have signed a conract. It does not say in listing that land is let out. Nobody has mentioned anything to me which I am seriously naffed off about and I am not remotely happy that someone has been on my land photographing our stuff and our horses (to use in pictures) without my permission.

I may not own the land but surely as I lease it and have a contract they should not be able to do this?
 
Oh god I am no good really as I dont know about this situation but can understand why your upset.
have you called the land owner to discuss?

Perhaps ask a legal bod on here for any help?
 
I can't get hold of her. Suprise suprise. I took the land on as a long term let so I am really upset. I spent 3 months sorting it out to get it horse safe, put in hundreds of hrs doing this and have spent a fortune repairing fences etcetc
 
My worst nightmare as I dont have a contract and my landlord told me last week next year our land will be divided up and he is renting the other half out to someone else! Phone a lawyer and / or landlord and find out what they are playing at. I hope it gets sorted for you.
 
i would demand that the pictures with your horses on is removed. They are not allowed to publish them without your concent. Not sure about the land though
 
Is it worth calling the auction agents? and tell them you a: have a contract b: fencing belongs to you c you have received no notice.

Dont think that is right - photographs belong to the photographer - there is some oddities on this one.
 
What does the sales literature say? Does it mention a tenant or vacant possession? PPM me if you wish.
Is the person you rent from the actual owner?

I would contact the selling agents.
 
omg does the contract mean nothing then? How the hell I am I supoosed to find somewhere for then in under a months time. I have not even been told its going to auction
 
This is a terrible situation!
I cannot offer any constructive advice but just wanted to say that that is awful. I can't believe that they can legally do that if you have a contract. It is very strange that the land owner has not kept you informed. In fact it is very strange that the land owner would lease you the land and then decide to sell it at auction only a month later.
 
I surpose if u have signed a agreement without it saying a time limit to which your horses can be on there or any information regards to selling I very much dought she can sell from

I would take your agreement to citizens advice or if you are a member of the bhs. To see where u stand on the mater
I can see why ur up set tho I would be if they took photos

if you are leasing the land, have you registered the lease on the land registary? as if so the people who buy the land should of looked on it prior to buying as if you reigstered they will see the current owner has granted you a lease for x amount of years. there is a way round it meaning they cant make you leave...cant remember it now but will try look it up...just an idea, i am studying law and we have just done land law so may point you in right direction....

Could it have been a clever ploy to get dilapidated land in a state to sell easier?

You do need to get the contract out and take a copy round to the selling agents, the owner probably can get you off but you should be compensated for your labour and expense which is to their benefit.

Any chance of going to see the owner then? I agree it does sound like reposession, which could explain why they let it out to you to try to get some income, and are now selling (hey are being forced to) perhaps.

Is there any way you would be able to sort out finance to be able to buy the land yourself?

thats right but just because they own the photo does not mean they can publish it.

I think that they can, especially if they weren't trespassing on the land to take the photograph. The owner of the land almost certainly gave them permission to be on the land, so sadly I don't think the OP has a leg to stand on.

I would guess the OP may be able to sue the landowner for breach o contract in order to recover the cost of the fencing and relocation costs etc, IF she isn't going to be a sitting tennant. However I think that should be sorted out first with legal advice from the BHS legal helpline or CAB.

Bumped as I would like to see what the legal bods have to say on this. Obviously if you were a tenant in a house with a contract you would have rights but wonder what it is if you are renting land.

Really hope you get some answers pronto. Echo that at least you can try your local CAB office..
 
The price guide sounds very much as though it's a price based on current land values without a sitting tennant. I would seek legal advice - your house insuurance may cover you, or BHS membership would. I'd try to get an independent valuation of the land as it'd be considerably less as tennanted land - is there any possibility you could buy?
 
I don't know about the land, but recently an estate agent was advertising a house on our lane and took a picture of my horses on my land because the house they were selling over looks my fields.

As they had not asked permission to take the picture (Even though the picture was theirs) I asked them to remove it. It took one visit to their office and two phone calls before they removed it.

Even though the picture was their property they had used it to enhance the sale without my permission. They can not do that.


Unless you have a contract stating a length of time i.e 12 months etc then they can do what they like. AS for improving the fences etc the owner will only say that YOU needed to do this if you wanted to keep your horses safe.

Before I bought my own I rented it and the then owner did no maintenance at all. When we went to buy it the then owner asked a higher value because we had improved it. We threatened to remove all the fencing plus the extra lighting and water troughs. He soon stepped down.
