Help needed re Vet /court claim .Is a Vetting PPE classed as a Contract ???

i have a matter in my local small claims court regarding a vet who i feel was negligent when vetting a horse for me a few years ago .

Anyway , It seems to all be going well enough , however the vet solicitors are trying to say various exclusions apply to my claim because a vetting , 5 stage , PPE , is not classed as a contract between me and the vet , etc
does anyone think or know that it is or would be classed as a contract ???

i have looked online and found a few bits and pieces that suggest a ppe is in fact a contract , on RCVS website but i have lost the part that seemed to pinpoint it word for word , anyone have any suggestions or where i can find the wording that i need ??

Surely the fact that you were paying for services makes that a contract?

I think I would call trading standards for advice - they are very helpful.
 
In English law, the contract was a verbal one between you and the vet, still legally binding, where he agreed to use a reasonable level of professional skill to assess whether the horse you intended to purchase was fit for the job that you told him that you required it to do, and you agreed to pay the vet for that service.

I don't know if Scottish law is the same, it often differs.
