HELP PLEASE- dont know what do do.

Right this could end up long, i will try and explain and keep it short, im so pee'd off and dont know what to do next??

Afew months ago my friends friends horses were being kicked off the yard they were on and had to go asap, owner of horses had apparently go off the rails and was depressed.
So my friends was offered a pony for £600, and told to take him and pay for him when he next saw her. There was one nice mare left, that had done bsja etc, i asked about her and he told friend i could take her on a trial, if i liked her he wanted £5k.

Took them to my yard. I rode mare for 2 weeks and had afew lessons, also found ut her whole background incluing the people who bred her. She is funny in the mouth, rideable but when jumping big fences you have to beable to see stride miles away and just keep rolling on it. Shes amazingly bred, and lovely but i decided that id be better concentrating on the 3 i have instead of another one aswell! Told bloke i wasnt interested and asked for him to pick her up. He couldnt come for afew weeks, so i told him livery price and he agreed to pay me livery upon her collection.
Friend with pony has decided to keep him, but hasnt paid for it yet.

Ok so one date and time passed, he never turned up. Sat he was ment to come again, never came. He ignored my text, and friends. I have text him this mornng to say, im not going to feed or muk out said horse and want it gone and my livery money!
I wont do that of course but thought it might provoke a reply!- NOPE, NOTHING!

Friends text him to and nothing again. What the hell do i do??

Its catch 22, the longer horse stayst- the more he will owe. I also cannot make him pick her up?

HELP PLEASE. Im at my wits end with this bloke, aarrhh should of left he bleeding horse where it was.
 
Can you get a lien on this horse? I believe this allows you to sell the horse to settle his debts.

When you would be entitled to keep possession, or even sell the horse for an unpaid livery bill?

Firstly, this will be governed by your written agreement with the owner. You can retain rights to hold on to and sell the horse.

Is there a lien without an agreement?

You cannot claim a lien when you have a horse on simple livery and provide no service.

Lien can arise if you train or school a horse, or you care for it through illness, upon a mare to the cost of covering by the owner of the stallion.

The principle here is the issue of improvement of the horse or "repair" of the horse. This is different to maintenance – here a lien will not arise.

What is the benefit of the lien? Can you sell the horse and tack or have the right to destroy the horse if the owner cannot be found?

Rule 2 – don't unless you have taken some legal advice.

You can have the right to sell, but you must give notice to the owner, in writing and give certain specific information, such as



Date of proposed sale

Amount owed

Must give a reasonable time



Cannot be used if there is a dispute

and

A lien allows the livery yard to retain possession of your horse until payment is made – however, it does not in its own right grant the yard owners the power to sell your horse. To do this, the livery owners would have to pursue you for breach of contract through the courts. If this happened, you would be able to defend the claim, but if the yard retained possession of your horse, they would be able to claim for any payment made on your behalf (feed or bedding etc).A lien can only be exercised while an individual has possession over an item, so once your horse is removed from the yard, the owners would no longer hold a lien over him. It would still be possible for the livery yard owner to pursue you for non-payment of livery.

put in writing a date for collection & monies owed & if it hasnt materialized start a small corts claim for the costs (or if you just and rid & have given up on the money) report to the police as an abandoned horse (which it is now)
