Homeless guy sells dog..

Don't come in here much but know you lot always have good advice.
A friend of mine has just messaged me with a problem and I appologise now if this is a bit long but she needs to know how she stands.
A friend of theirs bought an underfed puppy from a homeless guy, witnessed by a third party. He couldn't keep said puppy so he gifted it to my friends. They took it too the vets for fleaing and worming and he discovered a chip. On checking the details the dog was reported as lost or stolen the day before,( nine days after the sale) apparently this is quite the scam selling, report it stolen, get it back, sell it again!! They have told the guy they want to keep him but he said he wanted him back.
Where do they stand now as regards chip details, ownership etc? Do they actually own him asthe sale was witnessed?

Well it doesn;t make sense, I cannot believe a homeless guy paid to have a chip in. So who is the chip registered to? Did the homeless guy steal the dog from someone else? If the sale was witnessed by an independent third party and if the homeless guy has the dog registered to him then there is a sale. However how can a homeless guy have a chip registered to him when he has no home? You need a registered address. Something does not add up at all.
 
A very dodgy situation to be in but its worth noting that being registered on the microchip isnt considered proof of ownership, so he has no automatic right to the dog. If you have a witness to having bought the dog from whomever is now trying to claim it you have a stronger chance of being able to keep him.
If the vet agrees that the dog was malnourished when it was handed over it is another hold you have over the previous owner also.
Police are likely to see this as a civil matter for what its worth.

I am sure I read somewhere of a charity that provides treatment for homeless folks dogs (something to do with Dogs Trust I think), its possible they also chipped any dogs they treated.
 
The PDSA chip dogs for low income people and they can then apply for a government grant to help keep the dog healthy, £250 I am told. Can't say if the guy is 'actually' homeless but he was begging apparently so presumed homeless.
 
From what you say the homeless guy didn't 'gift' the dog. Your friends bought it from him.

The puppy will have been stolen from someone, and that's the way the thieves make their money. Take the dog to the pub or whereever, say they can't afford it, or they're homeless, or their auntie doesn't want it or some such rubbish, and that he'll have to get it put down if you don't take it off his hands for £10, £20, whatever. It's happened twice round here very recently. That chip in my opinion, will have been put in by the original owner's vet. They certainly shouldn't give the dog back to the 'homeless' guy, who will promptly sell it again.

They may however, which will be sad for them if they have grown fond of it, have to give Pup up to its original owners.
 
Dobiegirl the begger sold the dog to a guy who couldn't keep it,( his current dog hated it) so he then gifted it to my friends.

It's stupidly complicated as it's all a friend of a friend, he said/she said sort of thing, but she doesn't come on here herself, and I know this is the place for good advice!

The chip is most certainly not proof of ownership it is merely the identification for the dog.
The witnessed transaction that took place is the legal transfer of ownership from the seller to the buyer, the dog for the money. If of course the seller was the owner at the time and if they were not then they have either stolen or handled stolen goods if they did not have permission to sell the animal.

If the seller then reports the animal as stolen he had made a false declaration to the police and wasted their time, which is also an offence, they have also done this in the commission of a fraud.

The dog is legally owned now by your friends so I would tell this person straight that they either back off or face charges, that is the choice I would give them, I would also be reporting them to the RSPCA as neglect is what they are supposedly concentrating their efforts on these days!!!
 
I'm guessing the original owner has taken a few days of looking for his dog to try and find the find before reporting it missing-you have no leg to stand on tbh as with most of these things. The original owne rhas botehred to get pup chipped and reported it missing, so can't be that bad. Even if he is you have no right to withold hispup. Assuming it is not the homeless guy who has reported it missing, can imagine more he has found a pup and sold it to the easiest buyer.
 
And how do you know that say someone wasn't looking after the pup whilst owner was away hence it not being reported missing until owner returned? Etc. Etc. lots of different scenarios-have they spoken to owner? It could well appear underfed for many reasons...
 
Hi guys, thanks for all your help. I passed on the replies and got an update on the pup tonight.
The owner claiming the pup WAS the begger who sold it in the first place, apparently one of the mercedes driving homeless types! Friends have a statement from the witness of the sale and have told him they will go to the police with it. He has now denied he wants it back anyway.

Good news is pup gets to stay, bad news is I doubt it'll be long before he gets a new dog and starts again.
 
Many of these people arent homeless for a start off. Its the latest scam where they are going out begging and claiming benefits. They are making up to £400 a day and are now paying for decent spots. Some are even getting the train into London 4 days a week because the money is so good.

How the scam works is they take the dog, get it chipped and registered to their address, pretend they are homeless, get a the dog back and so it goes on. These people dont care about the dog they care about the money.
