All equines had to have a passport from 28 February 2005, is this correct? What date did it become illegal to sell a horse without a passport? I know the revised law came into effect in 2009.
 
The Horse Passport Order made it an offence not to have applied for a passport by Feb 2005.
For a passport issuer to issue a passport now for an older horse could be aiding the offence and they should be fully aware the horse most likely has a passport already and be very careful about what they do. The 2005 made it an offence to sell a horse without a passport
and the 2008 EU regulation 504/2008 makes it an offence to keep an animal without an identification document.
‘keeper’ means any natural or legal person having ownership
of, or in the possession of, or charged with the keeping of,
an equine animal, whether or not for financial reward, and
whether or not on a permanent or on a temporary basis,
including during transportation, at markets, or during
competitions, races or cultural events;
