Horse sold without Passport - Please Help!

Does anyone know where I stand legally. I bought a horse 10 days ago and was told by her owner that he would forward the passport as soon as the cheque had cleared. He is now being extremely difficult to get hold of and says he "can't find it". What should I do, I paid by cheque, but stupidly didn't get a receipt. What should I do? Please help!
 
If you believe him that the horse had a passport you can apply for a duplicate. You don't have to know who the original one was issued by. A duplicate would be marked as such but otherwise be a normal passport.

You have not committed any crime - it is illegal to sell a horse without a passport so he has committed the illegal act.

the passport regs are online so you can check.
 
The same happened to me off a very well known local competion yard/stud who took 2 months to reply and by this time threatened legal action so they sent it to us. odd. but the horse is superurb so if he is threaten him with legal action although with lack of proof that hes yours it may be hard to deal with
 
Report to trading standards. You have done nothing wrong in buying the horse without a passport, but the seller has in selling without one.

Contact them and let them sort it out for you. Dont worry yourself about it.

Have been through it and once trading standards got involved, the horse never had one and the owner is being looked at with a view to prosecution. I have applied for one now and have it for horse. You cannot just apply for another as you cannot have a duplicate for the same horse so let trading standards do the work they are meant to do.
 
The fact you paid by cheque will give you proof through the bank!!His name will be on the cheque

As regards passport,you were stupid to walk away without it....but am guessing you realise that

,as somebody else has said,threaten him with legal action and go to trading standards

....tis a long drawn out process,not helped by the fact you had no reciept or passport but hopefully the fact the cheque was in his name etc will help!!
 
Things are sounding a little odd with regards to your horses passport dont you think????

The fact that you have committed no offence buying a horse without a passport is of little consequence, you will need one. Contact the seller in writing, keeping a copy for yourself. Request the horse's passport & inform them that unless you receive the passport within a set period of time then the matter will be reported to Trading Standards. Hopefully they will comply rather than have Trading Standards on them.

All this could have been averted though couldn't it if you'd have had your head screwed on in the first place.

Check if hes nicked. If not, you have two options: 1. If you know which PIO his passport was with, apply for dupliucate (as above) 2. If you dont know PIO, apply for a new passport. Might be a bit naughty, but horsie needs one ASAP.
 
Same story I got when I bought my filly as I had her delivered to me and low and behold no passport accompanied her, passport was going to be sent, waited months, then it was "lost" in the post. Problem for me was I needed the life number for insurance so when she was hospitalised through colic (she had a HUGE worm burden when she arrived and me worming her as normal didn't touch it) I ended up with a £2500 bill that I had to find. Be very careful!

OMG - people are being so snitty today!!!
newbie comes here for advice and gets head bitten off! Passports as the system stands are a nightmare! Totally useless, not proof of ownership and just a ridiculous bureaucratic disaster!

newbie comes here for advice and gets head bitten off! Passports as the system stands are a nightmare! Totally useless, not proof of ownership and just a ridiculous bureaucratic disaster!

.....we all make mistakes.

One of my horses was delivered without a passport...fortunately the dealer was local so I followed her back to the yard to get it but if she's lived miles away I would have had to wait for it to arrive, which it may well never have done.

As others have said - send a harshly worded letter and wait for it to arrive, if not contact Trading Standards.

Although frankly, passports are a waste of time...if you read the smallprint they are not proof of ownership anyway.

A duplicate passport can be issued (and will be marked as such, by the PIO). You have to sign the 'not for human consumption' declaration, to cover the possibility of restricted medication being given before the passport was issued, but most people sign that, anyway!

Did you have sight of the passport and did you vet see it at the vetting?
 
Thanks all for your help, you are right, I do sound really stupid! I have known the horse for years and half know the guy, so thought he was straight down the line . . . more fool me, however, I do know she isn't stolen.
I saw a copy of the passport as "the real one was in a safe place" and was told it would be delivered with her - then it wasn't!
When things started to look a bit tricky I became worried about proof of ownership & vaccinations etc. However, went to the bank today and they keep cheques for 6 years - I wrote on the back that it was for purchase of horse etc etc so that should be fairly conclusive proof.
I think he genuinly has just lost it, but I don't want to be liable for his stupid mistakes & having to re-start vaccinations when the poor love has already had them for this year, and also trying to find out where to apply for duplicate passports etc, so hopefully he'll come up with the goods - we'll see!

If he cant find the original the copy will do just fine to send to the PIO to say the original is lost (take a copy of the copy first)
As above dont beat yourself up but do get on the right side of the legalities asap
This could cost you money to put right if you need flu vaccs to be correct for competing so suggest he owes you money back
