I've had my horsebox parked outside my house for just over a year, it's an Iveco Daily. Today I got a parking ticket "code 56 parked in contravention of a commercial vehicle waiting restriction" This can't be right can it?

Is it blocking the view of any neighbours? Anyone new moved into the street that may have reported it? Some estates say that you can't have large vehicles/ caravans etc on them.

Its just a bit strange that its been there a whole year without anyone caring!

Hope you get it sorted x

It sounds to me like a neighbours got fed up of it. Ive recently started working for the local council and its amazing how many people ring up over parking issues. What is the offence though, doesnt make sense to me???

Yep, new neighbours! It doesn't affect anyone as parked outside disused Waterboard property but there is a car that jumps into my spot every time I move although there is plenty of no-mans land parking. The only restriction on the road is a 5T limit and it is clearly marked as under that so I can't see it is a valid ticket??

I would appeal it, you should win if theres no rules being broken and its a private vehicle not a commercial one.

Do check for any estate bylaws tho, is yours a newish house (ie post 1960s?)

Sounds as tho its the usual revenue hungry council getting a complaint and going 'oh goody a soft target'. But unless theres a bylaw or a yellow line or it was an HGV def appeal it.

Parked in contravention of a commerical vehicle waiting restriction - non overnight waiting restriction £100 or £50 if paid within 14 days from date of service

Are you certain there are no large-vehicle restrictions in force?

I would query it on the basis that its not a commercial vehicle ( its private ) and therefore the commercial vehicle waiting restrictions, whatever they are, cant apply!!

Exactly, there have been loads of dubious tickets issued ever since councils took them over from the Police, even my husband got kept behind on nights once and was issued a ticket at 07.15hrs when the restrictions didn't start until 07.30!

Operators licences often have storage conditions/restrictions as part of their issue but your horsebox doesn't fall into that category either. So long as it's taxed and insured and not blocking anyone's access, don't see what the offence is.

You're not allowed to park lorries on the street at any time of day even if a private vehicle.... think it applies to anything bigger than a van

250
Cars, goods vehicles not exceeding 1525 kg unladen weight, invalid carriages, motorcycles and pedal cycles may be parked without lights on a road (or lay-by) with a speed limit of 30 mph (48 km/h) or less if they are

•at least 10 metres (32 feet) away from any junction, close to the kerb and facing in the direction of the traffic flow
•in a recognised parking place or lay-by
Other vehicles and trailers, and all vehicles with projecting loads, MUST NOT be left on a road at night without lights.

I guess they could get me on this one, but the ticket was issued in the daytime?

has anyone found the mythical rule 56, they cant issue a ticket on 56 and then rely on 250.....good spot to find 250 tho, bet OP will keep the lights on in future. Must admit Id never come across than one before.

56 Parked in contravention of a commercial vehicle waiting restriction

Looks to me that this is the one they are quoting (googled 'parking rule 56') but yours is not a commercial vehicle anyway, regardless of any commercial restrictions that may be in force, so it does not apply and I would definitely appeal it.
