Horses being dumped!

Hi, our livery hasn't been up for weeks to see their horses and we have now sent them a txt to leave giving them one months notice, would of called but they had their phone turned off!
Any way people have being saying that if they dont remove the horses and after writting to them they still dont remove them, then we legally have ownership of them.
Is this correct anyone?
 
Depends if it's written in the livery contract? I would suspect you'd need to contact the RSPCA/ ILPH and find out for certain, but if you havent passports then you can't really do much.
 
hiya, a friend of mine had this happen with a little arab. Anyhow she eventually managed to apply for a replacemnet passport for it and managed to sell it in the end, so you must be able to gain ownership
 
It is illegal to sell a horse without a passport but not illegal to buy one!!

One good reason for YO keeping passports as has been proposed. A pain for the YO who has been dumped on.
 
It is a pain, even more so as we think one maybe in foal!
I have no idea if they have passports and they are on our land at home, we're not a livery yard, we just wanted some one to bring there horse to keep my mums company as I moved mine to another yard, and they pay a little bit of rent.
I think Il contact the ILPH or RSPC in a week or so if we dont here anythinh from them, as by then it will nearly be two months since they last came up!
How people can do that to their horses i dont know.
 
So have they not been shod for 2 months or are they barefoot? To be honest if it was 2 months since they last came up I wouldn't bother waiting a week. If they can't make the commitment they don't deserve them IMO.
 
Did they used to be caring owners or have they always been inconsistant ?The reason i ask is has their circumstances changed in anyway,ie bereavement,ill health or deep financial problems?It just seems amazing to me that anyone could walk away from their horses without there being a bloody good reason.

Two horses were dumped at my yard to begin with the owner spun a story saying that he was ill then he all of a sudden dissapeared unfortunately one off the horses passed a way as he was old and they other horse who is only 4 is getting brought on my the YO and according to the SSPCA she is within her rights to sell him on as she cannot get a hold of the owner as long as she sends a letter to the SSPCA once she has sold him if she decides to and photographic proof of the horse and a recipt and where he is going there is no illegalities of what she is doing so in all reality i would say the horses have been dumped and it looks like they are your responsibility

but how can anyoneleave them to there own devices for 2 months? what about flies and water! sickens me
 
NO you cannot unless you have a lien clause in the contract, then you have to state, that if payment has not been received for x amount of time them horse/s and goods will be sold and the money taken to the value owed, rest of monies will be send to owners address
 
There was a pony dumped at my yard and the YO backed it and used it as a riding school pony and was legally (i think) allowed to sell it after 5 years, it is a long time, though. Maybe you could get some legal advise - take them to court and if they aren't willing to pay the livery costs you might be able to take the horses instead.
 
Hi, they are kept bare foot and their feet arn't too bad at the mo, it's only been a month so far that they havn't been up, but they hav'nt replied to our months notice we sent, or been up since that last week, so IMO they are'nt gonna come up, I have a feeling they will just dissapear one day, but who knows, im just wondering what we do if they are still there in 3 weeks when they should be going!
They did have a death in the famlily but wern't really coming up much before that, and that was two months ago anyway.
And they do work next door to the yard, they have no excuse not to pop in and check them.
