horsey people, what do you think of this? Court Case!!!

I am a horsey mum to 2 x pc children. I advertised my youngest daughters pony on a website as a lead rein or first ridden, pc pony for more competant jockey. and the first interested party came & tried & took the pony on a weeks trial , with written agreement that a full refund would be given if pony returned within period( she was a novice rider 4'9 adult) and decided to keep him. I later discovered that she was selling him as a first ridden 100% Safe pony etc. with my pics, 6 months later I now find myself attending a small claims court. due to fact that she now states I mis represented him and he is now unsafe???? I must add that she is now also advertising for wanting a ride & drive pony for 1 hrs work around her village. I am so angry. She came with an experienced horsey advisor to see & try him, who said if he was anything better he would be dead. I am only posting this as a beware, so many dealers get a bad reputation but I am a privtae sellar with no sales experience and this has really shaken my trust
 
Agree with PiebaldSparkle, but do make sure that if it does go to the small claims court that you fill out the defence form and send it in, as otherwise they may decide that you are agreeing with her.
 
thank you for your comments of support. I have submitted 4 witness testimonies from registered instructors stating his impeccable behaviour during rallies, lessons, being clipped etc and shod but am really frustrated that I am in this postion where I am defending my own opnion and judgement
 
The woman is obviously an idiot, what a shame that she feels the need to behave in such a ridiculous way and waste taspayers money into the bargain.
 
friend sold a horse , to a somewhat eccentric foreigner, recently agreed to buy the horse back after having to persuade eccentric foreigner to sell to her , after horse failed vetting with someone else!!! Paid for horse directly into their bank account , Collected the horse, seller was busy working , told her to just load up herself, he had misplaced passport , would look it out and forward.

few days later said eccentric foreigner , was offerred more money from someone else and has contacted police saying my friend stole the horse , and that the payment , done through bank was not correct etc , not full price etc !!!

police dont know whether they are coming or going !!!

what will happen ??? like rockinghorses story , theres always someone who wants to cause problems!!

I cant say for definite, he gave her a signed receipt for purchase of horse, stating that he had received the first payment , which was deposit .

then she paid balance couple days later.

has anyone had similar thing happen ? outcome??
 
Provided the 1st receipt stated the agreed sum, her bank statements will the prove the final transfer, so he won't have a leg to stand on..............................Guessing it could get messy otherwise.

Passports aren't proof of ownership, but by moving the horse without the passport your friend was breaking the law.

he said to my friend he couldnt find it at the moment , then she spoke to him the following day after balance was paid , and she collected horse , and he said he had found it and was about to fill in her details and pop it in post for ownership change, all very nice of him , then 2 days later he causes a riot and says he was wanting more money for the horse etc , although he originally said it was reduced due to failing a vetting the week before, due to injuries etc
 
bit confusedunless i am reading it wrong but did younot say in your first sentance that youdid advertise her as first ridden?
 
Selling horses is always difficult. Although horses behave one way with you, you have to remember they are in a familiar environment, they have a routine,and are use to you handling/riding them.
I can remember buying my first horse, her previous owner was a teenager who had lost interest and never went up the stables. The horse was turned out in a field and just left. Before I even agreed a price with her previous owners I spent a month going up the stable, riding and handling her. I had lessons and did everything with her to make sure she was the right horse for me. After the month I decided I had my dream horse and agreed a price with the teenagers mother.
I moved her to a different yard and all was fine for a while. Then the fun started. My dream horse turned into a nightmare! I couldn't do anything with her, not even lead her without getting dragged down the field. I was distraught didn't know what to do. Luckily I didn't give up and after a couple of months my dream horse started to come back. 6 years on I still have her and she has never put a foot wrong since.
I can't be sure but the fact that she has only done this once in 6 years and it being so close to the time when she had such big changes in her life makes me think she did it because she was unsettled and unsure what was happening.
 
i am a bit confused.
1 you advertised him as reid rein, first ridden for more competent jockey

2 she advertises him as 110% safe first ridden

now she is claiming that he is unsafe.
so for her to advertise him as this safe pony she must have taken him to that level.
so if now he is unsafe, how can it have been anything to do with you?
she hasn't got a leg to stand on.
 
What a nightmare. I feel so awful for you.

I am buying my first horse in about 10 years after years of loaning and I'm finding it rather stressful. I have uncovered so many things about horses that the owners are not upfront about - luckily before I have driven hours to see them!!

I have now found a horse I really like and luckily for me the people I am dealing with are brilliant and they also use HHO so we have a nice level of trust in each other

im taking dealer to court over two horses sold to me as vice free they both wind suck one naps could go on but my point is you hav no real come back with a private seller.if you buy from a dealer you hav more rights sale of goods act etc so this silly person dosnt stand a snowballs in hells chance its been hard enough with rights to get any justice good luck
 
What a load of crap - did it take her 6 months to work out he was 'unsafe' PMSL!! She had him on trial, she accepted him. Even if he was now unsafe, that isn't anything to do with you, horses can change depending on who handles them, their surroundings etc. The small claims court is there to decide if one party owes another money, not disputes about whether you mis-represented him or not. I can't see how any court is going to agree you owe her money.
 
Hi after suffering over 2 hours at court the district judge dismissed the claim so I should feel happy I won the case. (but actually now feel that I want him back and have trawled the internet to see if he is up for sale again)In his summing up he stated that he was a british eventing judge!
 
I am glad you had a successful outcome at court today; exactly as it should have been. The woman is an idiot I fear; I hope the pony is sold onto someone far better than her.

I have always said that a horses temperament can change depending on who handles it. My friends pony walks all over her but he doesn't even try it with me, she lets him get away with it and he knows it, and that is why another friend who got gifted a horse that had been allowed to get away with all manner of bad habits (and that's when he was actually handled at all) now has a happy and confident horse on her hands that is finally beginning his work under saddle.

I could put up here the glowing praising words from after he arrived there, but I know the truth, actually deep down so do all of you, I know that, that's the daft thing, it's hate that says otherwise, and hate distorts everything it touches, I could say I offered to pick up this ned free of charge if it was EVER needed before he even arrived there, so why wasn't that taken up on - if he was so bad like, but hey, what's facts when there's rumours to be had instead...LOL
