as you know ive got a new loan horse,got him sunday !!
well i have spoke to owner on a number of occasions to get her to take him back,she has told me she would come down 4 times to help me with him and see if he behaves for her but she keeps making excusses,ie its a bit windy or hes a bit het up not tonite,i cant bring him in to yard as he bolted and tried to jump gate he is just not suitable for me and i do not want to risk his or anyone's life basically !!!
now im being told i have to rite a letter giving her notice i have tried telling her that when you have a months trial period you do not need notice but she insists !!
he is atm a liability and the poor boy is just stuck in field being looked after.
its a shame that it has turned out like this but he really cant stay and she hasn't been down to try and do anything with him,its getting me down also if i get transport she says i have to pay for it,she also says she needs to give him a calmer and use bridle to bring him in !!!!
what do i do ? im sorry its so long !!!!
 
well at least you know he probably isn't all that well behaved for her normally if she's reluctant to come and have a go herself and normally brings him in using a bridle. Is she far away? will it cost you much to transport him back? It may be that you just have to accept paying it if you want to send him back - not ideal but if she's being difficult it might be the quickest way to make sure he goes back to her...

You can always just write a letter saying: Horse will be delivered back to you on xxx at xxx am/pm as is not suitable for me. Send it by recorded post and she'll have to sign for it.
 
Sounds like you have made your mind up about him going so - If it was me I would write a letter stating you want to end the loan and she is to come and collect him (I take it that in the contract she has transport responsibility?) and recorded delivery it to her.
It won't be doing him any harm if hes just out in the field (as long as hes not stressed etc).
Check your contract - whats the notice period agreed? If she doesn't comply to that then I would consider paying someone to move him for you - and then bill her for it.
Sounds like she's scared of him herself to me.....
 
I'd agree that checking your contract would be first port of call. At the end of the day it is STILL her horse and STILL her responsibility. I would be fuming if I was you.

Personally i would just go the whole hog and tell her if she doesnt colelct the damn thing you'll tie it up to a fence somewhere and attatch it's passort to it's headcollar. Sorry, but its her horse.... and she obviously doesnt give a fig about it.
 
this is the first week of month trial !!
i have told her she has to take him back and she said i would have to pay transport fee unless i wait for her to sort it out from her end but i dont know when that mite be,it says in contract if she things hes not happy etc she will pay for transport !!
he is very settled in field not scared at all.
unfortunately yo says he no longer wants the horse here and if it wasnt for yo graabing horse as he was about to take off horse would have been over gate and gone !!!
 
this is what im worried about !!
no where in contact has owner told me about his behavior and the classic he was fine when i went to ride him but now hes not !!
 
If it were me I would speak to anyone I know with transport, get him loaded and sent back asap. I would return it to her with a letter detailing why he is unsuitable etc. The longer you have him as your responsibility...the longer she is going to stall things... Spend some money on transport and get rid of the problem!!!
 
Has no-one on your yard got a lorry/trailer?
Or a friend?
It would probably be cheaper to ask a friend to help you out rather than going through a company.

Whereabouts "down south" are you?
 
yes we have a trailer here but to be honest i dont want to risk it getting broken as it not mine !
and also have told her she needs to load him as i dont want anyone down here getting hurt,it took her an hour to load him at her end to get him here !!

Then it sounds like you are in a Catch 22 situation - if you wait for her you get the journey free, but if you don't then you are going to have to pay transportation costs. She is right though to be honest, generally these month trial periods set out that if the owner is not happy and wants to bring horse home early then she has to pay, if the loaner is not happy and they want to bring the contract to a close, then they are the ones who have to pay to return the horse.

If it were me, I'd just call a shipper in and send the horse back to her.

PS. It should be in writing to cancel this contract though, so again she is right about that I'm afraid. Tough lesson learned I hope.
 
the first month is a trial then a 12 month loan after trial if we both decide that he stays with me !!
she has not stated in contract that he needs a calmer for anything or needs a bridle headcoller and possibley a whip just to bring him in to yard for a groom etc !!
is she not in breach ?
 
I would do as Tia says, pay for a shipping company, they will get him on and get rid, it will cost you money but at the moment you are paying livery etc (I take? ) so he is costing you anyway and you can't do anything with him
 
yeh the poor boy is just sat in the field,happy as larry but sat there although i think its more or less what hes been use to by the way he reacts as soon as you get him out of the field gate !!!
 
you need to get rid its no good dilly dallying about the longer it goes on the worse it will be she is clearly taking the **** so tell here he has to be gone by this weekend good luck.
 
I guess at the end of the day, it really doesn't matter who is in breach or who isn't - the fact is you do not want the horse therefore if you can't wait for her to collect it then you will have to pay to ship it back to her.

These things in life do have a positive aswell as a negative remember; you will have learned soooo much from this experience and it will set you up for the next time.

I had exactly the same situation with a month's trial. Horse had done much less than the owner had said, so after 3 weeks of re-backing it I said I'm sorry but this isn't the horse for me, how do you want to arrange return of said neddy.

She then said that she'd given up her field and that it was not convenient I'd have to keep her.

I was still paying out for feed and bringing it in to groom every day. Things got nasty and I was accused of not caring for the horse, so I said that if she didn't arrange a date when I could return the horse (at my cost), then after 1 week had passed and the trial was up she would be liable for all costs as well as my time or I would be leaving said horse in her front garden or at the original field. This did the trick and the horse was gone within the week.

Personally I would say it's being returned on such and such a date to the place you got it from. If you have trouble loading it, the professional horse transporters are good at loading problems or last resort, get it sedated and get rent a crowd to lift it into the lorry. Do make sure you tell them in advance so they have allowed extra time tho!

Locally, Paddy Foot from Sturminster is a patient transporter and Ben Lyles is good at loading problem loaders.

poor you, it's not the horse's fault but you end up so wary and I certainly took a long time to trust any horsey people after that! Hope you can sort it. If not, do you know anyone who is good at sounding bossy and scary who can phone them?
 
yes deffinatley learn that there are people out there that will not be honest just so they can get rid of the horse !!
although yes the horse isnt entierly sutable for me i mite have tried to work with him although i didnt want to get hurt really,but i have no choice as yard owner does not want the horse there full stop as he has to think of the safety of the other liveries so what choice do i have !!
if i had a spare few grand i would buy one and not worry about this loan hassle !!!
if anyone knows of a nice honest horse up for loan i will be on the look out again soon !!! as i have a nice cosy stable ect waiting for the rite boy !!
 
thank you horsimous,its not nice is it,somone did try and speak to owner but she went off on one and said she would not talk to anyone but me !!
no it is not the horses fault bless him he needs reschooling and needs manners on the ground,he just went crazy dad was stood at gate whilst he was cantering across yard towards him !!
his exact words to me where he was wild eyed and it was like there was nothing between his ears !! how can i cope with a horse like that !!!! im not worlds stongest woman and i dont want to start using gadgets on him to controll him !!
not for the sake of a loan !!!!
 
Look in the back of Horse of Hound and phone up a transport company. Tell her the horse is coming back as soon as they can drop take it back to her. Don't worry about how it is to load - they've seen it all. You had it on trial for a reason - to see if it would work out - but it didn't so get it gone as soon as. You have done nothing wrong, its her responsibility. I would be on the telephone sorting out transport now if I were you! Good luck.

i do feel bad and that i have failed the poor boy !
if i had known half the things that was wrong i wouldnt have dreamt of taking him on !!
 
I think the only person thats failing this horse is its owner, certainly not you
