if ive signed a transfer of owner ship

A passport isn't proof of ownership but seeing as the old owner must have counter signed the transfer slip, I'm guessing she'd find it difficult to prove she hadn't.

She did sign the transfer slip did she?

Did she not give you a written receipt for the horse?
 
If you have her signed over and have the transfer form then technically she is yours. However, this may not stand up in court as no money changed hands. Did you prior to this have a loan agreement?
 
Yes she was on loan and i was told to sign her over whenever i wanted and was given a signed transfer of ownership for. i then sent that off a few weeks later and her passport has me on as her owner. i paid the £9 transfer of ownership fee.
 
I hope you got a receipt stateing she was yours???
Iv had 2 signed over to me and I always get the owners to write a receipt " sold as seen for the sum for £1" to cover me in case this happened. Even if you only paid a £1 the horse is sold.
 
passports are not proof of ownership. you have probably registered as a keeper! you really should have notionally bought her and got a receipt. however if the old registered keeper has signed the transfer form to re register you might be ok. its a grey area. fight your corner if you want to keep, otherwise return tomorrow and tie to gate. cant have it all ways, but legally you should be able to contest ownership if she signed the transfer, unless your loan agreement states otherwise.
 
Don't panic. Get proper advice on Monday. From your equine insurance company, BHS if you have gold membership, or even household insurance may cover this.
Is there any chance her ex-owner might turn up and try to take her? If so, move her now and argue after.
 
i had a signed transfer of ownership form, i paid for this to be processed and passport has me as register owner.

i also have a letter from prev owner saying "i have included a signed change of ownership form for you and will leave it in your hands, if u want to keep her on loan that is fine, OR if you want to keep, keep her, do not hesitate to send it off tomorrow or 5 months down the line, just let me know"

you say that she gave you the transfer form when you took the horse on loan? if that's the case then she COULD argue that she thought transfer needed to be changed as the horse was put on loan to you. she could claim she didn't know how it worked and because the passport needs to stay with the horse she assumed the passport needed to be signed over to you as well.

i'm not saying that's right BUT that's how she may try to play it.
 
I'm certainly no expert but I would say that if she signed the horse over to you, then she's yours. But I would move her asap just in case. Maybe Citizens Advice could help?

And it's all very well saying you should have asked for a receipt - you didn't. It can be difficult to ask for one if you haven't bought the horse for cash off a stranger.

Who was the passport issuing authority? Notify them straight away that the horse has been taken. If you have her address I would get on to Trading Standards as they should not have transported her without a passport this is illegal. TS can ask them to produce the passport on demand.

If she was 'given' to you and ownership transferred - they cannot argue that no money changed hands. Your 'consideration' is that you have looked after this pony for how long? Send her a livery bill.

It is a woolly area of UK law that a passport is not proof of ownership, in France we have a single one page document separate to the passport which IS proof of ownership.

Out of interest what was the reason for wanting the pony back?

In my view the covering letter she sent you is some proof that she was fine with giving you the horse. She said if you wanted to have her she was yours!

Do you know where she lives?

I'd start a knew thread asking Legal Advice. Because in my view she has now stolen your horse and you possibly should be contacting the police!! (in fact I would anyway!)
