Insurance and previous injuries

Sorry I know there have been millions of insurance questions but I don't think this has been covered, but correct me if I'm wrong!

Hypothetical question of course.....!

Say you are buying a horse and the previous owner tells you of an injury the horse sustained years ago, it was treated correctly and the horse has been sound ever since.

Would you tell the insurance company about this?

What if the owner wasn't nice enough to tell you this information, you would be none the wiser.

Well when you ring up for insurance they do ask you of you know of any illness or injury and if you reply no then technically it's fraud as you do know. I suppose it's up to you what you choose to do.
