Is my hat legal for XC under BE/BRC rules?

Only with a BSI Kite mark. The peak actually isn't a fatal issue (no pun intended) but the kitemark is. Uvexx do make compliant hats - but they are more expensive. The ad does say it is for leisure riding.
 
You don't need to bother looking inside for the standards, it has a peak and therefore not allowed for XC whether it has a kitemark or not. The following is taking from information which can be found on the BRC website:

IMPORTANT INFO FOR THE CROSS COUNTRY PHASE: Only a “Jockey Skull” of an even round or elliptical shape with a
smooth or slightly abrasive surface, having no peak or peak type extensions may be worn for any XC phase. Noticeable
protuberances above the eyes or to the front, not greater than 5mm, smooth and rounded in nature are permitted. It must also
comply with the ‘Protective Headwear’ criteria and be tagged as set out above. A removable hat cover with a light flexible peak
may be used.

This is incorrect information as it still won't be legal for XC even if it had a kitemark.

Actually a small peak / protuberance is permissible in FEI. But I agree not under Current BE rules.
 
This would definitely not be allowed XC at BE/BRC because of the peak. They do make a version of this helmet with the kitemark so legal for Dressage/SJ but I would advise checking with the retailer as older batches do not have them.

The change in wording allowing a small protuberance was because there was controversy over the PROtector helmet not being allowed BE for a time.
