I was chatting to a guy who has a few acres which I am going to potentially rent from him.

He currently has a lady with 3 cobs on it. While we were chatting away he was saying how he'd had to put a round bale of haylage in a week for them to stop them breaking his fences, it was implied these were not paid for!

He also asked me if I go down every day - if I ride etc again it was implied this person kind of doesn't bother with their horses - not even going to see them and leaving it down to farmer man to look out for them!

According to farmer man, these horses were hooligans. He'd actually been invoiced, and paid, a vets bill for one of the horses, when it broke through the fence and raided the feed shed and eaten everyones food. It was the farmers fault because the food was there in the first place apparently.

Now, firstly I think that if you rent a field - you rent it in a certain condition and any damage your horse causes and subsequent damage to the horse is the owners responsibility - would you agree?

Secondly, the care of the horse is down to the owner, obviously the land owner has a duty of care but really, what owner lets someone do that unless they are on livery and paying for the privelige??

I feel a bit sorry for farmer man - and lastly - he's asked them politely and hinted for them to leave lots, but they aren't taking the hint - and I want the land, how can I put it across to him I'd be a much easier person to rent to and to chuck them off and HAVE ME!!?

Sounds like they are incredibly rude, unfortunately people like that know that other people won't put up with them so I bet they will resist being told to leave.
 
I think he's just too nice and a little naive!

MS - I might just ring him tonight and say that! I mean this lady has to be the worst livery ever, she's let them trash 5 acres of grazing, fences, bills, wont leave when asked - I know I can do a zillion times better than that!
 
Well she said it was his fault that her horse got ill. Forget the fact her horse broke his fencing which he had to replace, but then when it raided the feed store and gorged itself it was deemed his fault so she presented him with a bill. Which he naively paid!
 
Yeah sorry its her responsibilty to make sure the fencing is safe.
Thats neither here nor there, he paid it so that was his choice.

But she does sound a nightmare and needs to be moved on so you can have the place lol.
 
She sounds like a difficult livery. However, if she rents the paddocks it may be reasonable to expect that the fencing is stock proof - so without knowing what the fencing was like it is hard to tell whether she was unreasonable in blaming the farmer for her horse escaping? For all we know, the fencing could be bad and she might have asked several times for it to be repaired etc... You haven't heard both sides to the story...

It is fair enough to ask to rent the field though, and with a contract things are likely to be clearer.
 
has he got any kind of written agreement with her? if nothing then tell him to give her notice and get someone more reliable he will notice the difference - it's hard telling someone to shift their horses (I know I had to do it) but it's working out so much better now with who I'm sharing with. good luck
 
_CJ_ For me I would think after you accept the paddock - you are responsible for the fencing and if YOUR stock causes damage you would be responsible for repairing it?
 
_CJ_ as i believe it, it dosnt matter who owns the field, if you rent a field and your horses escape causing damage to people/property then its your falt and down to you to make sure that the boundary fence is secure.

Im not sure how it works like that but thats what iv been told. I think its to do with being the ocqupier of the field, if you are renting it then its your responsibility (unless of course its written in a contract)
