It's xmas eve and I'm fuming!! What are my rights/advice pls

Sorry to be in such a bad mood on Xmas eve but I am actually livid!!

I went down to do my horses yersterday evening and when I got to my middle field where my three Shetlands are I could see a lot of brown and thought to myself that can't be all poo. On closer inspection it was large cob size hoof prints, holes, skid marks all over my field!!!

The horses on the field next to mine have pushed down my fencing which was sturdy as it kept my other escapee shetland and my other horse in!! Run riot around my field and most probably chasing my three Shetlands one who has poor feet so she has probably suffered.

Put their horses back in their field, put a pallet up to stop the coming back over (although there are numerous places they could try and get through again). Left my fencing on the floor, pig wire and post up to next post just lay across the floor which is a hazard (I hate pig wire but it's what was already there and waiting to be replaced).

Not bothered t, call round to tell me or leave a note on my gate or feed room door or bothered to tell the lady next door who they probably think still owns the land!!

Had they at least called round and said we are very sorry, we will repair your fence I wouldn't have minded but to not even acknowledge the fact that their horses have caused damage to my fencing and land has really peed me off :(

Problem is she is not a very nice lady. How best do I approach her and what is reasonable to ask her to do as she rents the field and sub lets it to her liveries?

Does she even know her horses have done this? Mine went through or over a farce today, horses do these things and it's not the owner's fault. Just speak to her (not tomorrow!) and see what you can sort out, no need to worry or be funny about it, just organise better fencing. Whose fencing is it?
 
Yes she does know that's what's annoyed me more than anything as she has put her horses back in and put a pallet on her side to stop them. The fencing was decent as it was upright and sturdy, posts were secure as I have a shetland that will get out of anywhere are he never escaped out if there, her horses have pushed my fence down, don't think there is any fencing in her side! It's not my fencing of choice it's what the previous owner had up (I am currently in the process of changing it all to post and rail).

The questions you ask are valid . What concerns me is that you are allowing them to upset you. Take a deep breath and think of all the things that really matter to you, and then place this on the list. Near the bottom I think? We cannot account for the behaviour of others we can only account for our selves. Sorry if that sounds a bit zen like,!
 
Ha ha mike007 therapy!!

I am not as annoyed as I was, it's the fact there has been no attempt to even let me know or apologise and I am just recovering from an operation so am not myself. I put all my hours and money into my yard, I have spent thousands on post and rail fencing - just unfortunate I haven't got to that part yet.

It bugs me that's I put everything I have into making my yard better and safer and for someone else to trash it is disappointing to say the least.

And breathe ha ha
 
Why not move your horses to the part where there is post and rail? Understand your frustration, this used to happen on a daily basis at my yard lol. I used to walk up in the morning and find chaos! you just take a deep breath and repair it. Mind you, the main culprit has now left and only one break through for almost a year..............famous last words

I would be furious too. Can you get an estimate of the cost to repair the damage and politely give it to her and tell her what she owes you. A letter might be best, you won't be tempted to get angry and you will have a record in case you decide to follow it up. Yes, she is liable - you fence against your own stock, so even if it was your fencing, she has a responsibility to keep her stock on her side of it.
AngieandBen - so long as you do the repairs they will let you! Sometimes you have to make a point.
 
It was Xmas eve. The day of the year where half the country are rushing around like blue backsided flies and the other half are pissed.. The day of the year, second only to today, when most people would not have a spare moment to fix a fence, or even get things needed to mend it. She tried to block the gaps up for the meantime, try and relax for a day or two, get through Xmas and then see what happens..
 
Who owns the fence? If it dodgy then you do it. I'm sure the shetlands gave as good as they got... My liveries certainly does. My highland literally has a tiny tears moment every time he sees it

My Xmas morning was even better, ha ha, got a phone call from the lady who I bought my land off to say there was a shetland in with the cobs! One of my bloomin Shetlands has now escaped from what was a secure field which they have never got Out of in the 4 years I have been there. Luckily got down there Asap managed to get my shetland back into my field via the way he got out which is where they have shoved a pallet and last years xmas tree!! Now electric fenced my field in half again so they can't get down to the bottom.

I did have electric fencing up just not across that bit as it was secure before the cobs busted it. And post and rail field has my other three horses in it :(

Oh well, horses are not daft, they all know which bit of fencing doesn't work!!

JillA - All the fencing in my field is mine, the land is also mine, so my responsibility to fix it if they go through it, can't say it made me that mad, found it a pain to have to sort out, but all part and parcel of owning horses.

Can't say a pallet and an old Christmas tree would keep my ponies apart!
 
Sounds like you hadn't got a secure fence for your shetlands either - if a cob can push it down easily its not secure!
 
I can a sure you SusieT it was secure they have snapped the post holding it and bent all the pig wire. They only have two strings of barb wire on their side where as I had posts and pig wire fencing which has been up and kept my six horses in including my escapee shetland (not the one that got out yesterday), the one that got out yesterday got out where they got in 😞.

The field they are in isn't theirs and only has two strands of barb wire for fencing and now a pallet and last years xmas tree to what they think will secure it.

My fields are mine and were secure before the numpty horses from next door broke in.
Can't wait to have it all post and railed - it's just comsting a bloomin fortune :(
