James Gray released

What an absolute bloody Joke !!!! Bring back capital punishment - at least if they had hung him he could not be released !!!! ( my opinion and I am entitled to it ) !!!!!!!

What a joke, next they'll be saying they don't need to pay the fines and can keep a few ponies each as pets!!!

now we just got to get J.G back behind those bars and not this bail business ? suggestions anyone ?? we have done it before when he wanted the horses back

I have just read H&H on-line and see JG has been released on bail. Why am I not surprised?????? After all the work people have done to bring this to trial, not to mention the strain it has put on them, to see this happen must make them question why they even bother to get up in the mornings. As to a constructive way of getting them locked up escapes me at the moment.

Currently watching "Fistful of Dollars" perhaps we also need the man with no name!

How did he manage to get any appeal through so quick?

People who've committed far less heinous crimes sit in jail for weeks or months while they're waiting for their appeal to be heard.

Obviously it's who you know or how much you can pay.

This really is no surprise, his legal team have responded very quickly throughout the trial - remeber they nearly caught the RSPCA on the back foot over the matter of releasing some of the horses.

All he is doing though is putting off the inevitable and at some point will run out of options.

Ok, appeal has not been heard; appeal papers have been lodged as they have to be within 21 days of the sentencing hearing. If client instructs they wish to appeal, papers are forwarded to the court by lawyers or defendant themselves. Papers are a pro forma and need only set out brief reasons for the appeal so v quick to prepare. Once papers are received, the court will then list an administrative hearing to timetable the matter through to another trial in the crown court and this will all be subject to the availability of witnesses etc.

The Crown court judge can increase sentence but only to the maximum sentence for the offences in the lower court. The Crown Court can, however, increase costs payable.

Regarding the release of the horses back to JG during the trial - this was an ill-conceived attempt to have the horses returned by the High Court whilst the RSPCA were also applying for a stay on the order for return - hence the requirement for JG to pay £3000 in costs for that application.
